북한 소방법 개정의 과제

국문 초록

인간이 불을 이용하기 시작한 이후, 불은 사회 유지와 산업의 발전에 필수 불가결인 요소가 되었다. 그러나 인간의 관리범위를 벗어난 불은 화재로 나타나 해당 단위뿐만 아니라 지역이나 국가의 안정에 악영향을 끼치는 재난이 되고 있다. 이런 이유로 화재를 단속하기 위한 다양한 방법들이 나타났으며, 오늘날 세계 각국은 각 문화와 전통에 합당한 소방 규제를 도입하여 화재 예방과 진압 등의 목적으로 소방법을 도입하여 운용하고 있다. 소방법을 국가 행정에 관한 법으로 본다면, 소방 행정에 관한 북한의 공법이라고 할 수 있다. 일반 행정법의 개념은 엄격한 삼권분립을 근간으로 행정은 법에 기속되는 것으로, 법치행정의 기본이 되는 원리라고 할 것이다. 북한 역시 주민 생활과 산업 발전에 따른 화재위험을 규제하기 위해 소방법을 도입하였으며, 사회 변화와 기술 발전에 따라 그 내용을 수정하거나 보충해 오고 있다. 한반도에서 상생과 통일의 대상이면서 사회주의 국가로서 북한이 운용하고 있는 소방법을 분석하는 것은, 남한의 소방법과의 내용적 차이뿐만 아니라 북한의 소방환경과 함께 소방 안전관리에 대한 인식과 함께 재난으로서 화재에 대한 북한의 정책적 의지까지도 파악할 수 있을 것이다. 본 연구는, 개정된 북한 소방법의 내용을 분석하여 북한의 소방환경과 한계를 밝히고, 이를 바탕으로 남북한 소방법의 협력과 통합의 방안을 제시하고자 한다.

영문 초록

Since humans began to use fire, fire has become an indispensable element for maintaining society and industrial development. However, fires outside the scope of human management appear as fires, becoming disasters that adversely affect the stability of the region or country as well as the unit. For this reason, various methods have emerged to control fire, and today countries around the world introduce and operate fire fighting laws for the purpose of preventing and suppressing fire by introducing fire fighting regulations appropriate to each culture and tradition. If you look at the Fire Service Act as a law on national administration, it can be said that it is North Korea's public law on fire service administration. Since the concept of general administrative law is based on a strict separation of powers, administration is bound by the law, and it can be said that it is a principle that is the basis of the administration of the rule of law. North Korea has also introduced the Fire Protection Act to regulate the risk of fire caused by residents' lives and industrial development, and has been revising or supplementing its contents according to social changes and technological advances. Analyzing the fire fighting law operated by North Korea as a socialist country and subject to co-prosperity and unification on the Korean Peninsula will not only reveal differences in content from South Korea's fire fighting law, but also North Korea's policy commitment to fire as a disaster along with its awareness of fire safety management. This study aims to analyze the contents of the revised North Korean Fire Protection Act to reveal the fire environment and limitations of North Korea, and based on this, suggest a plan for cooperation and integration of the North and South Korean fire protection laws.
