국문 초록

법교육 과정에서 엔터테인먼트화 추세가 무시할 수 없는 문제가 되고 있다. 교육과정에서의 엔터테인먼트화란 원래 진지하고 전문적인 교육 내용이나 활동에 엔터테인먼트 요소와 형식에 재미와 흥미를 더하는 추세를 말한다. 문제는 이러한 추세가 법교육의 내용을 지나치게 가볍게 다룸으로써 원래의 교육내용의 깊이와 전문성을 훼손하여 도리어 교육 효과와 대중의 법률 지식에 대한 인식 수준에 충분한 효과를 거두지 못하는데 있다. 즉 대중의 법에 대한 지식과 이해에 도움을 주지 못하여 결국 법치주의에 대한 진정한 인식 제고에 충분한 효과를 거두지 못한다는데 그 문제의 소지가 있다 할 것이다. 이 논문에서는 법교육의 엔터테인먼트화 추세로 인한 문제를 해결하기 위해 이러한 추세성의 발생원인과 그 수정 방안에 대하여 심층적으로 분석하려 한다. 이에 대한 올바른 수정 메커니즘의 구축은 법교육 활동에 대한 관리감독의 강화를 통해 효과적인 교육 내용을 규율하는 규범을 모색하여 법교육의 정확성과 전문성을 담보하고 동시에 교육 활동의 효과와 영향을 정기적으로 평가하는 과학적 평가 메커니즘의 구축을 통해 문제와 단점을 찾아내어 교육의 효과를 개선하며 대중의 법률 지식에 대한 수용과 이해를 높이는데 기여할 것이다. 또한 이는 교육의 내용과 형식을 수정하고 교육의 전문성과 깊이를 향상시킴으로써 엔터테인먼트화 추세로 인한 도전에 효과적으로 대응하여 일반 대중을 위한 법교육의 근본 목표를 더 높은 수준으로 끌어올리는데 도움을 줄 것이다. 이는 법과 법치주의 개념에 대한 대중의 인식을 제고하는 데 도움이 될 뿐만 아니라 법치주의에 기반한 사회 건설을 위한 탄탄한 토대를 마련하는 데도 도움이 될 것이다. 따라서 대중에 위한 법교육의 엔터테인먼트화 추세를 수정하기 위한 모니터링 및 평가 메커니즘을 강화하는 것은 큰 의미가 있으며, 이는 정부 부처 및 관련 기관의 큰 관심과 지원을 받을 가치가 있다 할 것이다.

영문 초록

In the process of popularizing-law education, the pan entertainment tendency is a problem not to be ignored. The pan entertainment refers to the tendency of increasing entertainment elements and forms to make original strict and professional educational contents or activities to be more attractive and interesting. This tendency leads to that popularizing-law education contents seem to be too easy and superficial which lacks the depth and professionalism, thus affect the educational effect and the public’s awareness related to legal knowledge.1 The public’s awareness and the understanding of legal knowledge is insufficient, and it is unable to really improve the rule of law awareness. In order to solve problems brought by the pan entertainment, this paper deeply analyzes its reasons and the regulatory path. Through establishing the sound supervisory mechanism and enhancing the supervision and management of popularizing-law education activities, the implementation of educational contents can be regulated effectively, the accuracy and the professionalism of the education can be ensured. Meanwhile, the establishment of the scientific evaluation mechanism and the regular evaluation of the effect and influence of educational activities help to find problems and deficiencies, improve the educational effect, and strengthen the public’s acceptance and the understanding degree of legal knowledge. Through adjusting educational contents and forms and enhancing the professionalism and the depth of the education, which can effectively deal with challenges brought by the pan entertainment tendency and promote the higher level of development of the popularizing-law education career. This not only helps to enhance the public’s legal awareness and rule of law ideas, but also paves the solid foundation for establishing the rule of law society. Therefore, the enhancement of the supervision and the evaluation mechanism is of great significance to regulate the pan entertainment tendency in popularizing-law education, which is worthy of the high attention and support from government departments and relevant institutions.
