국문 초록

중국에서 個體工商戶는 이미 독립적인 사회계층으로 발전하였으며 사회생산력의 신속한 발전을 촉진하는 하나의 소홀히 할 수 없는 중요한 역량으로 형성되었다. 개체공상호의 발전의 생성과정을 돌이켜 보면, 중국 개체공상호의 생성과 성장은 기본적으로 중국 시장경제체제의 수립 및 건전성과 동시에 이루어 졌다. 이러한 기간에 비록 개체공상호의 발전이 완만한 상황도 나타났으며 심지어 어떤 단계에서는 저조하여 침체에 빠져지기도 하였다. 그러나 총체적으로 놓고 볼 때, 중국 개체공상호는 이미 시장의 검증을 받았고 시장법칙에 순응하면서 어렵고 험난한 과정을 거쳐 발전하고 성장하여 왔던 것이다. 중국 개체공상호의 생성과 발전에서 증명하듯이, 시장경제는 개체공상호가 필요하며 개체공상호는 시장경제의 토양을 떠날 수 없다. 개체공상호는 독립된 시장주체로서 기타 시장주체가 대체할 수 없는 시장기능을 지니고 있으며 시장법칙에 적응하는 끈끈한 생명력을 갖고 있다. 중국 시장주체체계 중에서 만약 개체공상호라는 이 하나의 독립적인 시장주체가 없다면 다원화된 시장주체체계는 완전하지 못할 것이며 시장도 활력이 없을 것이라고 말해도 과언이 아니다. 이러한 인식에 기초하여 중국은 개체공상호의 법적지위를 확립하고 개체공상호의 합법적 권익을 보호하는 법률제도를 구축함으로써 개체공상호의 건강한 발전을 위해 방향을 명확히 제시하고 법적보장을 제공하였다. 그러나 중국 시장경제체제의 건전성과 시장주체 경쟁의 격화에 따라 중국 개체공상호가 어떻게 경제 환경에 적응할 것인가, 어떻게 지속적으로 독특한 시장기능을 발휘할 것인가, 어떻게 자신의 시장이익을 보호할 것인가 등 일련의 새로운 상황, 새로운 문제, 새로운 도전에 직면하게 되었다. 따라서 중국이 개체공상호에 대한 보장 제도를 어떻게 건전화 시킬 것인가에 대해 새로운 과제를 제기하게 되었다. 중국 시장경제의 안정된 발전은 여전히 개체공상호의 존재를 떠날 수 없기 때문에 개체공상호에 대한 보장제도의 개선화가 절박하게 필요하다.

영문 초록

In China, individual business has grown as a separate social class, which has developed into an considerable important force that promote the rapid development of the social production. Looking back on the development course of Chinese individual business, the generation and expansion of it is basically synchronous with the establishment and soundness of Chinese market economy system. During this period the individual business there has been inthe slow development of the state, and even has paused at some stage in depression, but generally speaking, China's individual business complying with the laws of the market lived the test of the market and expanded through a rough time. The generation and expansion of Chinese individual business proved: the market economy needs of individual business, and individual business is inseparable from the market economy soil. Individual business, as an independent market entity, has unreplaced market functions contrasting against others and a tenacious ability to adapt the laws of the market. It is no exaggeration to say that, if there is no individual business as a independent entity in the system of Chinese market entity, the pluralistic system of market entity would not be sound and the market would not be dynamic. Based on this understanding, China has established the legal status of individual business and builtlegal systems maintaining the legitimate rights and interests of the individual business, which pointed out the direction for the healthy development of individual business and provided legal guarantee. However, with China's market economy system getting healthier and the competition among market entities intensifying, how would Chinese individual business adjust to new economic environment? How would it play unique market functions continuously? How would it protect their own market interests? When a series of new situations , new problems, and new challenges emerge, new topics come out that Chinese government how to complete its safeguard system of the individual business.
