국문 초록

이 연구는 묻지마 범죄(이상동기 범죄)의 대응과 관련하여 모든 형사사법기관들이 ‘범죄의 동기(원인)’을 중심으로 한 범죄정보를 공유하는 것이 가장 중요하다는 점을 전제로 하여, 범죄자가 전 형사사법 절차를 거치는 동안에 생성된 정보를 범죄의예방과 수사에 보다 효과적으로 활용하기 위한 「통합적 관리 방안」을 도출하는데 목적이 있다. 연구방법으로는 선행연구를 통해 묻지마 범죄의 개념, 유형, 분류방식 등에 대해 체계화하였고, 묻지마 범죄에 대한 관리실태 파악을 위해 경찰, 검찰, 교정, 보호 등 형사사법기관 실무자와의 인터뷰를 실시하였다. 이를 통해 각 형사사법기관간 정보공유를 통한 통합적 관리방안을 다음과 같이 제시하였다. 첫째, 묻지마 범죄 통계ㆍ정보를 형사사법기관들간의 매뉴얼을 통해 체계적ㆍ통합적으로 수집ㆍ관리해야한다. 둘째, 묻지마 범죄자에 대한 KICS 등을 활용한 AIㆍ빅데이터 기반 정보공유 시스템을 구축해야 한다. 셋째, 묻지마 범죄에 대한 국가적 연구역량을 강화하기 위해 형사사법기관-학계 간 공식적인 공동연구 기반을 구축해야 한다.

영문 초록

This study is based on the premise that it is most important for all criminal justice agencies to share crime information centered on the 'cause of crime' in relation to the response to so-called ‘don’t ask crime’(Abnormally motivated crime), and information generated while a criminal goes through the entire criminal justice process. The purpose is to derive an “integrated management plan” to use it more effectively in the prevention and investigation of crime. As a research method, the concept, types, and classification methods of ‘don’t ask crime’ were systematized through previous research, and interviews were conducted with practitioners from criminal justice agencies such as police, prosecution, corrections, and probation to understand the management status of ‘don’t ask crime’. Through this, an integrated management plan through information sharing between each criminal justice agency was presented as follows. First, crime statistics and information must be systematically and integratedly collected and managed through manuals between criminal justice agencies. Second, we need to establish an information sharing system using KICS for criminals. Third, in order to strengthen national research capabilities on crime, an official joint research foundation must be established between criminal justice agencies and academia.
