국문 초록

장기간 지속된 가정폭력범죄의 피해자가 가해자를 살해한 경우 정당방위의 성립이 가능한가? 우리 대법원이 가정폭력피해자에 정당방위를 인정한 경우는 한 건도 없었다. 그러나 법원에서는 여전히 가정폭력범죄 피해자의 가해자 살해사건에 대하여 위법성조각을 인정할 것인지가 사안의 쟁점이 되고 있으며, 형법학계에서도 ‘침해의 현재성’ 인정여부에 대한 이론적 논의들이 이루어지고 있다. 특히 심리학에서의 개념인 ‘매맞는 배우자 증후군’을 정당방위 해석론에 받아들이려는 논의가 활발히 이루어지고 있는데, 장기간 지속되어 온 가정폭력범죄 피해자에 대한 이해가 충분할 때, ‘잠들어 있는 가해자를 살해하는 행위’가 ‘현재의부당한 침해에 대한 정당방위’에 해당한다고 판단될 수 있을 것이다. 본 연구는 그간 가정폭력피해자의 가해자 살해사건에 대하여 위법성조각 인정을 위한 논의에 사용되어 온 ‘매맞는 배우자 증후군’에 대한 심리학에서의 논의들을 상세히 검토함으로써 가정폭력범죄 피해자의 반격행위에 대한 위법성조각인정을 위한 이해를 마련해 보고자 한다.

영문 초록

Would the self-defense be established if the victim of a long-lasting domestic violence crime murders the perpetrator? There has not been a case in which the Supreme Court recognized the case of domestic violence victim murdering assailant as a self-defense. However, whether to recognize a justification in the murder of the perpetrator in domestic violence has been a controversial issue in the court of law, and the theoretical discussions are taking place in the academia of criminal law. In particular, as the discussion of accepting ‘Battered Spouse Syndrome’-the psychological concept-as an interpretive theory of justification is being actively reached, the sufficient understanding of victim of long-lasting domestic violence would enable the judgment of ‘murdering a sleeping perpetrator’ as a ‘self-defense against the present unjust violation’. This study aims to provide an understanding in relation with recognition of justification regarding the counterattack of domestic violence victim via reviewing psychological discussion about ‘Battered Spouse Syndrome’ in detail, which has been used as a basis of argument, acknowledging justification in a case of domestic violence victim murdering a perpetrator.
