국군의 강령과 군인정신의 재구성

국문 초록

2016년 군인복무기본법이 제정되면서 군인기본권 강화되었을 뿐만 아니라 법적 지위도 강화했다는 중요한 의미를 갖고 있다. 문제는 군인정신 관련부분들이 체계적으로 결합되어 있지 않다는 점이다. 본 연구는 군인복무기본법과 시행령에 제시된 국군의 강령과 군인정신의 재구성을 통해 정신교육의 체계성과 논리성을 강화하기 위한 것이다. 우선 ‘국군의 강령’ 에 국군의 이념과 사명이 분리되어 있는데 이를 통합하여, ‘국군의 성격’, ‘근본과제’, 그리고 ‘미래지향적 과제’로 재구성할 수 있다. 법령에 분리, 배치된 군인정신은 해당 조항의 특성에 따라 (1) 개인 차원의 군인정신(‘명예’, ‘용기’, ‘충성’ 등)과 (2) 조직 차원의 군인정신(‘군기’, ‘사기’, ‘단결’, ‘교육훈련’)으로 구분하는 것이 필요하다. 개인 차원의 군인정신의 경우, 기존 6대 가치관과 더불어 ‘책임완수’를 별도의 가치로 분리하는 것이 법령의 취지에 부합한다. 개인 차원의 군인정신은 (1) 목표로서 '책임완수'와, (2) 이를 위한 행동규범(‘명예’, ‘용기’, ‘충성’, ‘필승의 신념’, ‘임전무퇴의 기상’), 그리고 (3) 이 모든 가치의 바탕으로서 ‘숭고한 애국심’으로 재구성함으로서 내적 연관성을 확보할 수 있을 것이다. 조직 차원의 군인정신의 경우, 이들 가치들이 개인 차원이 아니라 부대 조직 차원에서 확보해야 할 군인정신이라는 점. 그리고 부대의 ‘군기’나 ‘사기’, 그리고 ‘단결’은 ‘교육훈련’을 통해 강화될 수 있다는 점이 강조되어야 한다. 이러한 개념적 통합과 논리적 재구성을 통해 가치들 간의 내적 연관성이 확실해지면서 보다 체계적인 정신교육이 가능할 것이다.

영문 초록

With the establishment of the Basic Law on Military Service in 2016, not only the basic rights of military personnel but also the legal status was strengthened. The problem is that the military spirit-related parts are not systematically combined. This study is designed to strengthen the systematicness and logic of mental education through the reconstruction of the Code of the Armed Force and the military spirit presented in the Basic Law on Military Service and its Enforcement Ordinance. First of all, the ideology and mission of the Korean armed forces are separated in the “Construction of the Korean Armed Forces,” which can be integrated into “the nature of the Korean armed forces,” “fundamental tasks,” and “future-oriented tasks.” The terms of the military spirit separatedly deployed in the statutes should be reconstructed into two categories: (1) “honor,” “courage” and “honesty” at the individual level and (2) “military discipline,” “morale,” unity” and “education & training” at the organization level, depending on the characteristics of the provisions. On the military spirit at the individual level, it is in conformity with the law to recognize the 'completion of duty' as an independent statute along with the existing six values. The individual-level military spirit will be able to gain internal relevance by reconstructing into 3 tiers: (1) “duty completion” as a goal, (3) behavioral norms (honor, courage, loyalty, belief in unfailing victory, & no retreat) for it, and (3) noble patriotism as a essential basis for them. In the case of an organization-level military spirit, these values should be secured not at the individual level but at the organization level. it should be also emphasized that military discipline and morale of armed forces can be strengthened through “education and training”. This conceptual integration and logical reconstruction will ensure an internal consistency between military, enabling a more systematic mental education.
