설계 감리손해배상보증제도의 도입 방안

국문 초록

본 연구에서는 건설관련 부실설계 및 부실감리를 예방하고 손해배상 수단을 확보하기 위해 도입되는「설계·감리손해배상 보증제도」의 활성화를 위하여 구체적인 시행방안과 이에 따른 법적, 제도적 개선방안을 제시한다. 1998년 7월에 도입되는 보증제도는 세계적으로 유일하게 우리나라에서만 시행될 예정이어서 정확한 통계자료의 부족, 법적·제도적 미비점, 보증기관의 운용 미숙 등으로 많은 어려움이 따르리라 예상된다. 따라서 본 연구에서는 설계 ·감리손해배상 보증제도가 원활하게 시행될 수 있도록 손해배상보증의 대상용역, 의무화 가입대상용역, 손해배상보증의 범위, 손해배상보증한도 및 보증기간, 보증수수료 반영방안, 보증요율 체계 등 세부적인 운용방안과 이에 따른 관련 법령의 개정안을 제시한다. 아울러 설계·감리손해배상 보증제도의 문제점을 지적하고, 부실설계·감리위험을 보다 더 효율적으로 관리하고, 더 안정된 손해배상수단을 확보하기 위한 대안으로서 「설계·감리업자 배상책임보험제도」의 도입 필요성을 제안하는 것으로 결론을 맺는다.

영문 초록

This study presents specific operating schemes and accompanying legal and institutional reform proposals in order to facilitate 「the Architects and Engineers Liability Bond Systems」 which will be introduced to prevent construction-related design and supervision errors and obtain means of paying liability claims. Because the liability bond system to be introduced in July of 1998, is very unique and exists only in Korea, it is expected that there will be many problems arising due to the lack of statistical data, unpreparedness of legal and institutional provisions and inability of bond-operating institutions to operate. This study proposes specific operating schemes and accompanying legal and institutional proposals in the following areas; engineering services subject to the liability bond system, design and supervision required to buy a liability bond, the scope of liability bond coverage, the limit and period of a liability bond, the way of reflecting a liability bond fee, a liability bond rate system., etc. In addition, anticipated problems regarding a liability bond and the necessity of introducing the Architects and Engineers Liability Insurance System will be pointed out to better manage design and supervision risks and obtain more stable ways of paying liability claims.
