사이버 성폭력 범죄에 관한 연구

국문 초록

오늘날 사이버상에서 발생하는 범죄는 현실세계에서 발생되는 범죄보다 더 치명적인 피해를 발생시키고 있다. 이중 사이버 성범죄는 더욱더 심각하다. 사이버 성폭력 범죄의 경우 지속적인 증가추세에 있으며, 새로운 수법으로 적발되지 않는 경우도 많아 적극적인 대응이 필요해 보인다. 형사사법기관만의 활동으로는 방대한 사이버상의 성폭력 범죄를 감시할 수 없고 나아가 새로운 수법의 발전으로 인해 피해실태를 파악하기도 힘들다. 따라서 무엇보다 적극적인 신고를 통해 사이버 성폭력 범죄를 진압하고 예방해야 할 것이다. 이에 따라, 본 연구는 사이버상 발생하는 사이버 성폭력에 대한 억제이론적 관점에서 처벌의 인식이 신고의향에 미치는 영향관계를 로지스틱 회귀분석으로 분석하였다. 분석 결과, 사이버 성폭력 범죄의 처벌에 대한 확실성은 통계적으로 .05 수준에서 유의미한 결과를 나타났다. 이를 구체적으로 살펴보면, 사이버 성폭력 범죄에 대한 처벌이 확실히 이루어진다고 생각할수록 신고의향이 1.8배 높은 것으로 나타났다. 따라서 사이버 성폭력 범죄에 대해 처벌의 신속성, 엄격성, 확실성 모두 담보되어야 할 것이지만 사이버 성폭력의 경우 처벌이 확실하다는 인식을 가지도록 보다 정책적 대안이 모색되어야 할 것이다.

영문 초록

Crimes occurring on the cyber world today are causing more fatal damage than crimes occurring in the real world. Among them, cyber sex crimes are even more serious. In the case of cyber sexual violence crimes, there is a continuous increase, and there are many cases where they are not caught with new methods despite the strictness of punishment, so active response seems necessary. The activities of criminal justice agencies alone cannot monitor vast cyber sexual violence crimes, and furthermore, it is difficult to grasp the actual state of damage due to the development of new methods. Therefore, above all, cyber sexual violence crimes should be suppressed and prevented through active reporting. Accordingly, this study analyzed the influence of the perception of punishment on the intention to report from the perspective of inhibition theory on cyber sexual violence that occurs through logistic regression analysis. As a result of the analysis, the certainty of punishment for cyber sexual violence crimes was statistically significant at the level of .05. Looking at this, it was found that the higher the intention to report was 1.8 times higher as the punishment for cyber sexual violence crimes was clearly carried out. Therefore, the speed, severity, and certainty of punishment for cyber sexual violence crimes should all be guaranteed, but more policy alternatives should be sought to recognize that punishment is certain in the case of cyber sexual violence.
