교제폭력 피해자 보호의 실효적 방안에 대한 질적연구 - 경찰의 단계별 대응을 중심으로

국문 초록

교제폭력은 특수하고 친밀한 관계에서 발생하는 범죄 특성상 피해의 발견이 어렵고 중대 범죄로 이어지는 경우가 많아 국가 차원에서의 적극적인 피해자 보호가 요구된다. 이에 각종 법률에서는 경찰에 다양한 권한을 부여하여 교제폭력의 피해자 보호에 개입하고 있으나 범죄가 꾸준히 증가하면서 사건 대응과 피해자 보호에 미비점을 보이고 있다. 따라서 이 논문은 실제 교제폭력 피해자를 대상으로 심층면접을 진행하여 교제폭력의 특성을 살피고 경찰 대응 단계에서의 피해자 보호에 대한 실효적인 방안에 대한 문제점을 파악하고 개선방안을 모색하고자 하였다. 연구결과, 대상자들은 현장 대응시 피해자의 불안감 해소 미흡과 가해자에 대한 소극적 대응의 문제점을 지적하였다. 또한 조사 방식에서는 범죄 증거 수집의 소홀과 반복 질문의 심리적 부담 증가를 토로했다. 그리고 경찰의 안전조치가 적극적으로 행사되지 않고 피해자 요구 사항의 대응이 미흡하다는 의견도 제시하였다. 뿐만 아니라 정기적인 사후 안전 확인의 부족과 추가적인 피해를 대비한 지원 체계의 한계가 있음을 알 수 있었다. 따라서 경찰에서는 첫째, 대응 단계에서는 경찰 시스템 및 각종 정보 등의 적극적인 활용으로 가해자의 위험성을 신속하게 파악하여 엄격하게 신병 관리 및 분리조치를 시행하고, 반의사불벌죄라고 하더라도 위험성 재발을 위해 긴급임시조치 등 안전조치를 선행적으로 실시하여야 한다. 둘째, 조사 단계에서는 다양한 증거 확보를 통한 범죄 입증 및 신종범죄 예방을 위한 실질적인 노력과 함께 반복적 질문 최소화를 위해 사건 이송시 ‘피해자 진술 요약서’를 적극적으로 활용하고, 신고자의 진술 노출로 인한 보복 위협 방지를 위해 사건 과정에서 가해자 접근금지 등을 우선적으로 고려하여야 한다. 셋째, 피해자 보호를 위해서는 긴급임시(응급)조치 판단 조사표를 활용하여 위험성이 높은 경우는 처벌 유무에 관계 없이 반드시 사건을 접수하고, 대상자 관계 파악시 개선된 사실혼 판단 체크리스트를 적극적으로 적용하여 경찰 안전조치를 강화하여야 한다. 마지막으로 사후 단계에서는「스토킹 및 가정폭력 대응 매뉴얼」상의 전화 모니터링과 단계적 조치를 체계적으로 실시하고, 재발 우려가 높은 피해자는 우편 및 문자 알림서비스 등 안내를 추가적으로 시행하고 민간 상담 기관과의 연계도 필수적으로 진행하여야 한다.

영문 초록

Dating violence is a crime that occurs in special and intimate relationships, making it difficult to find victims and often leading to serious crimes, so active victim protection at the national level is required. Accordingly, various laws grant the police various authority to intervene in the protection of victims of dating violence, but as crimes continue to increase, there are shortcomings in responding to cases and protecting victims. Therefore, this paper conducted in-depth interviews with actual victims of dating violence to examine the characteristics of dating violence, identify problems in effective measures for victim protection at the police response stage, and seek improvement measures. As a result of the study, the subjects pointed out the problems of insufficient relief of victims' anxiety and passive response to the perpetrators when responding to the scene. In addition, the survey method complained about the neglect of criminal evidence collection and the increased psychological burden of repeated questions. They also suggested that the police did not actively enforce safety measures and that the response to the victims' demands was insufficient. In addition, it was found that there was a lack of regular follow-up safety checks and limitations in the support system for additional damage. Therefore, the police should first quickly identify the danger of the perpetrator through active use of the police system and various information in the response stage, strictly implement new recruit management and separation measures, and proactively implement safety measures such as emergency temporary measures to prevent the recurrence of the danger, even if it is a crime of involuntary impunity. Second, in the investigation stage, in addition to practical efforts to prove crimes and prevent new crimes by securing various evidences, the 'victim's statement summary' should be actively used when transferring the case to minimize repetitive questions, and prohibition of access to the perpetrator in the course of the case should be considered as a priority to prevent the threat of retaliation due to the exposure of the reporter's statement. Third, in order to protect victims, cases should be filed regardless of whether there is punishment or not in cases of high risk using the Emergency Temporary (Emergency) Measures Judgment Questionnaire, and police safety measures should be strengthened by actively applying the improved common-law marriage judgment checklist when identifying the relationship between the subjects. Lastly, in the post-incident stage, telephone monitoring and step-by-step measures in the “Stalking and Domestic Violence Response Manual” should be systematically implemented, and additional guidance such as mail and text notification services should be implemented for victims who are at high risk of recurrence, and cooperation with private counseling organizations should be carried out.
