국문 초록

우리나라의 경우 일반적으로 억울한 일을 당했을 때 법에 호소하여 문제를 해결하는 방법보다 혼자 참거나 민원을 통하여 해결하고자 한다. 소송을 제기한다고 할지라도 홀로 제기하는 소송이 많은 편이다. 실제로 소송에 관한 법률적 문제가 발생하게 되면, 비전문가인 본인 스스로 해결하는 것 보다 법률적 지식으로 무창한 전문가에 의한 조력을 받아야 하는 것이 상식임에도 불구하고 경제적인 이유 때문에 법률적 전문가인 변호사의 도움을 받기가 어려운 것이 현실이다. 일찍이 주요 선진국은 보험, 즉 법률비용보험을 통하여 이러한 문제를 해결하고자 하였다. 법적 분쟁을 해결하는 과정에서 무모하지 않으면서 충분하게 승소할 가능성이 있는 가운데 불가피하게 발생하는 비용, 즉 법원비용이라든가 변호사비용 등을 보험회사가 제공하기로 약정하는 보험인 법률비용보험을 통하여 법률보호의 사각지대에 놓여 있는 사람들에게 법률시장을 통한 권리구제가 용이하도록 하고 있다. 본 논문은 법률비용보험에 대하여 기본적인 의의, 특징 빛 법적 구조를 연구하고 독일의 법률비용보험에 대하여 연구하고 있다. 특히 독일의 대표적인 법률비용회사인 Deutscher Automobile Schutz AG(이하 ’DAS’)의 법률비용보험에 대하여 자세히 고찰하고 있다. 독일의 경우 소송비용 및 변호사 보수가 법정화 되어 있다는 점은 우리와 유사한 면을 보여주지만, 법률비용보험만을 전문으로 하는 다수의 보험회사가 존재할 뿐만 아니라 상품 자체가 단일한 보험으로 발전되고 있다는 점에서, 독일의 법률비용보험 연구가 시시점을 제공하고 있다. 독일계 회사인 DAS사가 독일식의 싱품을 우리나라에서 제공하고 있는바, 그것의 발전가능성을 지켜볼 필요가 있다. 법률비용보험의 발전과 함께, 독일에서는 약관에 의존하던 일부의 방식을 탈피하여 보험계약법에 명문으로 법률비용보험의 내용을 규정하고 있는 점 역시 입법론의 측면에서 주목해 볼 필요가 있다고 생각된다.

영문 초록

Legal expenses insurance is a type of insurance. This paper deals with the legal protection insurance in Germany. The insurer is obliged to provide the information necessary to perform the legal interests of the policyholder or the insured performance in the agreed scope (§ 125 VVG). This rule describes the objective pursued by a legal expenses insurance business purpose and thus gives the ambiguous term "legal" contours. The decisive factor is the agreement in the AVB. In legal expenses insurance, these are the general conditions for the legal expenses insurance (ARB), which call such costs as the main performance of the insurer in § 1 VVG. The separate documentation of performance in legal protection insurance from a treaty over several risks should clearly lead to the policyholder, the guarantee of legal protection in mind.
