타인의 생명보험, 단체보험 규정의 문제점과 개선방안

국문 초록

우리 현행 상법에서는 타인의 사망을 보험사고로 하는 보험계약의 경우 보험계약의 체결시에 피보험자의 서면에 의한 동의를 얻도록 규정하고 있다. 그리고 그 보험계약으로 인하여 생긴 권리를 피보험자가 아닌 제3자에게 양도하거나 보험계약자가 계약 체결 후에 보험수익지를 지정 또는 변경하는 경우에도 피보험자의 서면에 의한 동의를 얻도록 하고 있다. 그런데 타인의 사망 보험과 관련하여 피보험자가 위 동의를 사후에 철회할 수 있는지에 관한 명문 규정이 없었다. 이에 대하여 대법원은 2013. 11. 14. 선고 2011다101520 판결을 통하여 사정변경의 원칙에 의하여 피보험자가 동의를 철회할 수 있다고 판시하였다. 또한 단체보험과 관련하여 2014.3.11. 상법개정시에 상법 제735조의 3 제3항을 신설하여 단체보험의 경우에 “피보험자 또는 그 상속인이 아닌 자를 보험수익자로 지정할 때에는 단체의 「규약」에서 명시적으로 정하는 경우 외에는 그 피보험자의 서면 동의를 받아야 한다”는 내용을 신설하였다. 그러나 여전히 「규약」 의 의미가 불분명하다는 문제점은 있으므로 이는 향후 보험업법 시행령 및 감독규정에서 규약의 의미에 대하여 분명히 할 필요가 있으며 판례로도 이를 보완하는 해석이 나올 것으로 보인다.

영문 초록

According to the korean commercial act, a contract of insurance which cover the death of a third person as an insured event shall require the written consent of the third person at the tome the insurance contract is concluded. This shall apply if the rights arising from the contract of insurance have been transferred to the person other than insured. By the way there were no provisions that can withdrawal of the consent in reference to insurance which cover the death of a third person about this the Korean Supreme Court rules as the 2013. 11. 14. 2011Da101520. the supreme court said that the insured can withdrawal his consent by principle of the change circumstances. In reference to group insurance, commercial act article revised that in case of designation of insured or who not is the inheritor as beneficiary, the insured' s written consent shall be required except of clearly stated covenant. There are still problems that the covenant's meanings are unclear, next there is a need to clarify covenant's meanings at the enforcement decree of the insurance business act or regulations. I will come forward to complementing as judical precedent.
