일본 변호사배상책임보험제도 운영의 실태와 한국에 대한 시사점

국문 초록

변호사배상책임보험은 변호사가 법률서비스의 제공이라는 전문업무의 수행과정에서 불성실한 변론과 소송수행상의 과실 등으로 인하여 의뢰인 및 제3자에게 손해를 가한 경우에 부담하게 되는 법률적 배상책임 및 방어비용을 보상하는 손해보험을 말한다. 이러한 보험은 손해배상책임을 담보함으로써 변호사가 경제적 파산에 대한 두려움 없이 안정적인 업무수행을 할 수 있으며, 피해를 입은 고객에 대히여는 확실한 손해배상을 보장함으로써 생활의 안정과 전문직업인에 대한 신뢰를 회복시키는 기능을 수행하고 있다. 한국이 2002년에 변호사책임보험제도를 도입하여 운영하고 있는 것과 비교하여, 일본은 1976년 동 보험제도가 도입되어 시행되고 있지만 법률시장의 환경 등이 유사하고 비슷한 유형의 법제도를 가진 한국과 마찬가지로 변호과오소송 및 변호사배상책임보험이 활성화 되어있지 않다. 그러나 현대 사회는 발전할수록 전문가에게 점점 더 높은 수준의 전문지식과 엄격한 주의의무를 요구하고 있다. 따라서 앞으로 변호과오를 이유로 한 소송이 크게 늘 것이라고 예측되며 이에 대한 문제의식을 가지고 변호사배상책임보험의 안정적인 정착으로 대처하여야 할 것으로 보인다. 그리고 일본과 한국은 유사하게 법학전문대학원을 도입하여 변호사 수의 급격한 증가와 법조계의 소송환경의 변화로 잠재적 위험은 점점 증가하고 동 보험의 수요는 확대 될 것이라 예상된다. 본 논문에서는 일본의 변호사배상책임보험의 운영과 제도의 특징 등에 관하여 개괄적으로 살펴봄으로써 한국이 동 보험의 발전과 정착을 위해 어떻게 해야 할 것언지에 대한 시사점을 얻고자 한다.

영문 초록
