형사조정프로그램의 이상적인 모델구성과 적용방안

국문 초록

본 논문은 형사조정프로그램의 모델에 대한 논의를 바탕으로 현재 시행되고 있는 형사조정프로그램의 이상적인 모델과 실제적인 적용방안의 제시를 목적으로 한다. 형사조정 모델에 관한 논의는 조정목적에 따라서 화해형 모델과 문제해결지향형 모델로 구분되고 둘은 상이한 목적을 지향하는 모델이다. 화해형 모델은 당사자간의 관계회복을 강조하며 배상 등의 합의결과 도출보다는 피해자와 가해자의 대화를 강조하는 인간적이고 미래지향적인 해결책을 지향하는 반면에 문제해결형 모델은 당사자의 요구를 상호 만족시키는 해결책을 모색하고자 하는 것으로 분쟁해결 중심의 사고에 기초하고 있다. 한편 조정진행 과정에 대한 단계적 모델에는 형사조정회의의 진행과정을 강조하는 기능모델과 형사조정의 진행과정을 '형사조정 준비활동', '형사조정활동', '형사조정 이후 활동'과 같이 세 가지 수준으로 확장한 균형모델이 있다. 회복적 사법의 이념을 지향하는 형사조정프로그램은 범죄로 인한 피해자의 피해회복과 가해자와 피해자의 관계회복이라는 두 가지 요소를 함께 추구하여야 한다. 즉, 가해자와 피해자의 이해관계 및 손해배상과 동시에 화해를 통한 미래 관계회복을 동시에 달성하여야 한다. 따라서 본 논문은 화해와 분쟁해결을 동시에 지향하는 통합형 모델을 변형된 균형모델 속에서 구현하고자 하며, 그 구체적인 방안을 형사조정의 진행 단계별로 제시하였다.

영문 초록

The purpose of this study is to present a desirable model of victim offender mediation(VOM) based on discussions about mediation models and present the measures for development of VOM through empirical data on the process of victim-offender mediation. The purpose of VOM is to realize the philosophy of restorative justice. Therefore, there is a need for recovery from injuries from criminal acts and the reconciliation of relationships between the offender and victim in victim-offender mediation. In the goal of the mediation, VOM can be divided into two models: the reconciliation model and the problemsolving model. Although the two models may contradict each other, a model that incorporates the purposes of both models may result in the realization of restorative justice. On the other hand, there are two models related to the process of victim-offender mediation: the functional model and the balanced model. The functional model focuses on the session of victim-offender mediation while the balanced model focuses not only on the session of the victim- offender mediation, but also on the pre-mediation and post-mediation activities. Therefore, this study constructs ideal model of VOM through the model that expands on the three levels including pre-mediation, mediation session and post-mediation activities in the process of mediation and the model that integrated reconciliation model and the problem-solving model in the goal of mediation.
