국문 초록

본 연구는 법원에 협의이혼을 신청한 부부를 대상으로 협의이혼 전 상담을 통해 그들의 협의이혼원인과 과정에 대한 사례를 분석하는 데 의의를 두고 있다. 연구 대상은 B법원에서 미성년 자녀를둔 남편 40명과 부인 40명을 선정하였으며, 연구 기간은 2013년 5월부터 2014년 8월까지 약 16개월동안 진행되었다. 연구 결과, 첫째, 협의이혼의 주요 원인은 폭력, 외도, 경제 문제, 성격 차이, 도박, 가족 간의 불화, 건강 문제로 나타났다. 이들 요인은 부부 관계에 심각한 영향을 미치며, 이혼 결정을촉진하는 중요한 요소로 작용하였다. 둘째, 협의이혼의 과정에서는 교육 수준이 높을수록, 결혼만족도가 낮을수록, 월평균소득이 높을수록 협의이혼의 경향이 증가하는 것으로 확인되었다. 이는 사회적및 경제적 요인이 부부의 관계에 미치는 복잡한 상호작용을 보여준다. 셋째, 연구는 결혼준비교육의필요성을 강조하며, 예비부부가 필수적으로 교육을 받도록 하는 정책 방향을 제안한다. 이러한 교육은가족 기능 강화와 부부 관계 개선을 위한 프로그램을 포함하여 협의이혼을 예방하는 데 기여할 수있다. 본 연구는 협의이혼 문제를 해결하기 위한 실질적인 방안을 모색하는 데 중요한 기초 자료를제공하며, 향후 정책 개발 및 사회적 인식 개선에 기여할 것으로 기대된다.

영문 초록

This study focuses on analyzing the causes and processes of mutual divorce through pre-divorce counseling for couples who have applied for mutual divorce at the court. The research subjects included 40 husbands and 40 wives with minor children from B Court, and the study was conducted over approximately 16 months, from May 2013 to August 2014. The findings reveal that the primary causes of mutual divorce include issues related to violence, infidelity, economic problems, personality differences, gambling, family conflicts, and health issues. These factors significantly impact the couple's relationship and serve as critical elements that facilitate the decision to divorce. Furthermore, the study indicates that the likelihood of mutual divorce increases with higher educational levels, lower marital satisfaction, and higher average monthly income. This highlights the complex interplay of social and economic factors affecting marital relationships. Lastly, the research emphasizes the necessity of premarital education and suggests policy directions that mandate such education for prospective couples. These educational programs could enhance family functionality and improve marital relationships, contributing to the prevention of mutual divorce. Ultimately, this study provides essential foundational data for seeking practical solutions to mutual divorce issues and is expected to contribute to future policy development and social awareness improvement regarding this matter.
