학생인권조례 시행 이후 학생들의 인권 경험: 서울 S 고등학교 사례를 중심으로

국문 초록

본 연구는 학생인권에 대한 질적탐구를 통해 학생인권이 어떻게 경험되고 있으며 그 의미는 무엇인지를 탐색해 보고자 수행되었다. 본 연구를 위해 연구자는 8개월동안 진행한 학교 현장연구에서 만난 학생들의 경험을 묘사하고 분석하였다. 여기서는 문화기술지와 사례연구에 기초하여 관찰, 면담 그리고 그림 그리기 방법 (draw-and-tell method)이 포함된 질적 설문지를 통해 수집된 자료들을 분석하였다. 본 연구에서는 1) 학생인권조례 이후의 변화: 통제방식의 변화 그리고 2) 인권이란? 자유와 존중이 있고 차별이 없는 학교라는 두 주제를 중심으로 논의하였다. 연구자는 이를 통해 변하지 않은 시험과 통제제도 속에서 제한될 수밖에 없는 학생인권의 경험과 그럼에도 불구하고 교사-학생의 관계 속에서 갈망되는 인권의 의미를 되짚어 볼 수 있었다. 나아가 학생인권의 문제는 결국 학교 교육 체제 안에 있는 모두의 인권문제로 되돌아옴을 확인할 수 있었으며, 학생인권 실현을 위해서는 통제와 시험, 차별이 만연한 학교문화에 대한 총체적인 접근과 성찰이 필수적으로 요구됨을 알 수 있었다. This study attempts to analyze the discourses of students’ human rights through qualitative inquiry to explore the experiences of students’ on human rights and its meaning. In this study, I describe and analyze the experience of students I met during 8 months of school fieldwork. Observation, interviews, and a qualitative questionnaire, which included the draw-and-tell method were used to collect the data. Based on the analysis of the collected data, the following themes were discussed: 1) changes after the enactment of Students’ Human Rights Ordinance; the continuation of control and discrimination; and 2) Human rights? schools based on respect and freedom without discrimination. From these discussions, I was able to realize how the experience of students’ human rights are limited in circumstances where examination and control system are strongly valued. And nevertheless, I was able to find the meaning of human rights, which students hope for in students-teachers relations in particular. Finally, I was able to recognize that the issues of student human rights lead us to think about human rights for all in school system and that it requires holistic approaches and reflection on control, examination and discrimination which in fact are deeply embedded in school culture.
