교원 정치적 기본권의 포괄적 제한에 관한 헌법재판소 결정례의 “교육” 개념 검토

국문 초록

교원의 정치적 기본권을 둘러싼 논쟁은 줄곧 평행선을 달린다. 본 논문은 이 논쟁에서 문제 설정 자체의 전제가 타당한지 여부를 검토한다. 이 논쟁에서 찬반 인사 모두가 헌법재판소 결정례를 중시하니 이를 분석 대상으로 한다. 제1기 교육학을 비판한 장상호의 ‘그릇된 교육관’ 유형을 분석틀로 한다. 그릇된 교육관은 ‘관습적 교육관’, ‘용병학문적 교육관’, ‘결과위주의 교육관’ 등으로, 교육외재와 내재를 혼동하여 교육을 은폐할 뿐 아니라 국가주의 따위의 문제를 야기한다. 분석 결과, 주요 결정례(89헌가106, 2001헌마710, 2018헌마551) 모두 그릇된 교육관을 답습하고 있었다. 특히 관습적 교육관과 결과위주의 교육관에 기초하여, 학교체제 내 비교육까지도 “교육”으로 칭하는 동시에 교육외재의 규칙과 가치를 교육에 적용함으로써, 부당한 요구를 주문하고 있었다. 그러나 2018헌마551은 “교육”의 재개념화에 기초한 교원의 정치적 기본권 보장이 ‘학교∩교육의 내실화’에 우호적일 가능성을 부분적으로나마 보여준다.

영문 초록

The debate about the political fundamental rights of teachers shows no sign of abating. This paper examines whether the premise of the issue itself is flawed. It uses Jang Sang-ho’s ‘the wrong view of education’, which criticises the first period of education studies, as a framework for analysis, and constitutional court cases that are considered important by both proponents and opponents of guaranteeing teachers’ political fundamental rights. The wrong view of education includes “conventional approach to education”, “heterogeneous disciplinary approach to education” and “result-oriented approach to education”, which confuse the extraneous and internal of education and not only hide education but also cause problems such as nationalism. Specifically, in both traditional and outcome-oriented approaches to education, even the extraneous of education within the school system was labeled as ‘education,’ with its rules and values applied to the educative process. However, in ‘2018heonma551’(2018헌마551), the Constitutional Court partially shows that the guarantee of teachers’ political fundamental rights based on the reconceptualisation of “education” may be favourable to the consolidation of the core of school∩education.
