관광취약계층의 관광 활동에 관한 자치법규의 분석

국문 초록

본 연구의 목적은 2014년 개정된 「관광진흥법」에 의해 사회적, 경제적 여건 등으 로 인해 관광 활동에 제약을 받고 있는 관광취약계층에 대한 지방자치단체의 조례를 분석하여 바람직한 자치법규의 입법 방향을 제언하는 것이다. 먼저, 본 연구에서는 관 광이라는 개념과 취약계층이라는 개념이 결합된 새로운 개념인 관광취약계층에 대한 그 의미를 고찰하였는데, 사회정책 대상인 노인, 장애인 등도 포함될 수 있지만, 스스 로 소득 활동을 할 수 없거나 제약이 있는 저소득층 등 공적 급여에 대한 수혜의 ‘조 건’에 해당하는 계층으로 전통적인 저소득층, 노인, 장애인 등은 물론, 기존의 수급자 뿐 아니라, 1인가구, 여성, 다문화, 청년, 새터민 등의 새로운 취약계층들까지 포함하 고 있다. 다음으로, 국가법령정보센터의 자치법규를 활용하여 관광취약계층 조례는 3 건, 관광약자 조례는 43건, 무장애관광 조례는 15건으로 검색되었고, 본 연구에서는 중복된 조례들을 제외한 총 55건의 조례들을 내용분석 방법으로 분석하였다. 연구결 과, 「관광진흥법」 개정 이전부터 유사 조례가 제정되었고, 동법 시행 이후에도 관광 취약계층 조례와 별도로 유사 조례들이 우후죽순 제정되었다. 유사한 조례 목적이나 정책 대상, 단체장의 책무, 그리고 정책사업 등이 조례의 종류에 따라 구분되었지만, 상당수의 조례들이 관련 법률과 일치하지 않음에 따라 신체적, 사회적, 경제적 여건 등에 따라 관광 활동을 제약받는 취약계층 중 일부는 누락 또는 배제되는 상황이 발 생하고 있다는 사실 역시 확인할 수 있었다. 이에 본 연구에서 조례 및 법률 등이 개 선되어야 할 사항을 제언하였다.

영문 초록

The purpose of this study is to analyze local governments' ordinances for tourism vulnerable groups who are restricted in tourism activities due to social and economic conditions under the Tourism Promotion Act revised in 2014, and to suggest a desirable direction for autonomous regulations. The first part of this study examined the meaning of the tourism vulnerable class, a new concept that combines the concept of tourism and the concept of the vulnerable class. The meaning of the concept may include the elderly and the disabled, who are targets of social policy, but it also refers to classes that meet the ‘conditions’ for receiving public benefits, such as low-income people who are unable or have limitations in self-earning activities. Therefore, it includes not only the traditional low-income group, the elderly, and the disabled, but also existing beneficiaries, as well as new vulnerable groups such as single-person households, women, multicultural people, youth, and North Korean defectors. Next, this study examined a total of 55 ordinances, excluding duplicate ordinances, among the tourism vulnerable class ordinances (3), tourism vulnerable groups (43), and barrier-free tourism ordinances (15) retrieved from the local government regulations of the National Law Information Center. It was analyzed using content analysis method. The research results show that similar ordinances were enacted even before the revision of the Tourism Promotion Act, and that even after the enforcement of the Act, similar ordinances were enacted in droves, separate from the tourism vulnerable class ordinance. This means that similar ordinance purposes, policy targets, responsibilities of group leaders, and policy projects are classified according to the type of ordinance, but as many of the ordinances do not match the relevant laws, some people from tourism vulnerable groups are omitted or excluded from the policy. It meant that something was happening. Accordingly, the conclusion of this study suggested matters that need to be improved in ordinances and laws.
