경호경비적 관점에서 자치경찰제 도입에 관한 시론적 고찰

국문 초록

이 연구는 2021년 새롭게 전국적으로 도입되는 자치경찰제도에 대해 조직, 인사, 사무, 재정 측면에서 살펴보고, 자치경찰제의 도입 이념인 민주성, 정치적 중립성, 분권성, 효율 성이라는 네 가지 평가기준에 얼마나 부합하는지 분석평가함으로써 문제점과 정책적 시사 점을 도출하는 것을 목적으로 한다. 연구결과를 살펴보면 다음과 같다. 첫째, 민주성의 달성 측면에서 “경찰청장”, “시도지사”, “수사본부장”이 삼분하여 경찰사무에 관여하고 있고, 시도지사는 시도자치경찰위원회를 통해서 간접적으로 “자치경찰사무”에 대해 간섭할 수있다는 점에서 경찰에 대한 민주적 통제는 미흡하다. 둘째, 정치적 중립성 측면에서 일원화 모형은 시·도 자치경찰위원회의 구성과 관련하여 시·도지사가 과다한 영향력을 행사할 수있다는 우려가 제기될 수 있다. 셋째, 지방분권의 이념 측면에서 현재 국가경찰공무원을 그대로 두고, 사무의 일부만 자치경찰사무로 명명하며, 시도자치경찰위원회를 통해 시도지 사가 간접적으로 간여하는데 그친다는 점에서 지방분권의 이념을 충실히 달성하고 있다고 평가하기는 어렵다. 넷째, 효율성 측면에서 대단히 부정적인 요소가 많다. 경호경비 기능및 조직영의 제1원칙이라고 할 수 있는 “명령통일의 원칙”을 정면으로 위배하고 있고,.국가수사본부의 신설을 통한 수사사무의 분리는 또 다른 비효율 문제를 야기할 수 있다. 결론적으로, 일원화 모형은 자치경찰제 도입 그 자체로 역사적 의미를 부여할 수 있다. 향후, 자치경찰제도 도입의 기본이념을 충실히 달성할 수 있는 온전한 형태의 자치경찰로 발전 되어야 할 것이다.

영문 초록

This study aims to review and analyze the four main issues of organization, personnel, task, and finance of the uniformized municipal police system, which will be established in Korea, as well as the current four criteria for achieving democracy, political neutrality, decentralization, and efficiency. For this purpose, the position of the National Police Agency and the Provincial Governor s Council on the uniformized model, the opinions of the field police officers, review reports of members of the National Assembly s Public Administration and Security Committee, and discussion materials were widely used. The results of the analysis on the four assessment criteria, including democracy, are as follows. First, it takes an indirect control method in that it operates municipal police around the municipal and provincial police committees appointed by the city and provincial governors, and it is not a strong model for democracy in that there is no direct control over the residents municipal police. Second, the municipal and provincial police commission, an administrative body of the agreement system, is required to independently perform the duties belonging to the municipal police to prevent the strong authority of the city and provincial governors and thereby the police authority. However, while there are concerns that the city and provincial governors may exert excessive influence on the composition of municipal and provincial municipal police committees, which are key to securing political neutrality, the council of city and provincial governors insists on reducing the influence of the National Police Commission. Third, it seems difficult to see the realization of decentralization in the real sense. Fourth, the separation of investigative affairs through the establishment of the National Investigation Headquarters could negatively affect efficiency. From the security perspective, this is because the cooperative system between functions that can easily occur when the principle of command and leadership is broken may collapse, or it may be difficult to reconcile ambiguous tasks and conflicts.
