국문 초록

교회는 하나님에 대한 예배와 선교라는 목적을 달성하기 위하여 일정한 조직하에 운영된다. 법적 측면에서 우리나라 대부분의 개신교 교회는 비법인 사단의 형태로 존재하고 있으므로 구성원이 되는 교인이 없는 교회는 존재할 수 없다. 민법은 비법인사단의 법률관계에 관하여 재산의 소유 형태 및 관리 등을 정하는 제275조 내지 277조를 두고 있을 뿐, 사단의 실체·성립, 사원자격의 득실, 대표의 방법, 총회의 운영, 해산사유 등에 대해서는 규정하고 있지 않으므로 민법의 사단법인에 관한 규정 중 법인격을 전제로 하는 조항을 제외한 나머지 조항이 준용된다. 따라서 교인의 확정은 교회의 의사결정과 운영에 있어 매우 핵심적인 요소이고 교회 분쟁의 예방과 신속하고 합리적인 해결의 기초이다. 하지만 실제로는 종교단체의 자율성, 국가의 불간섭, 그리고 교회 행정의 미비, 교인 유형의 다양화 등으로 인하여 교인을 확정하는데 어려움이 많다.그러므로 본고에서는 교인의 확정이 필요한 이유와 교단별로 교인의 종류 및 그 지위를 취득하는 절차를 살펴보고, 교인지위의 상실의 사유인 교회의 탈퇴, 장기간 불출석, 권징재판 등에서 나타나는 법적인 쟁점을 검토하여 대비하며, 교인의 확정을 둘러싼 분쟁을 예방하고 해결하기 위한 실천적인 방법을 고찰하고자 한다.

영문 초록

Churches are operated under a certain organization to achieve the purpose of worship and mission to God. In legal terms, most Protestant churches in Korea exist in the form of unincorporated associations, so a church without members cannot exist. The Civil Act only provides Articles 275 to 277 that stipulate the form of property ownership and management regarding the legal relationship of unincorporated associations, but does not stipulate the entity and establishment of associations, acquisition and loss of member qualifications, methods of representation, operation of general meetings, reasons for dissolution, etc. Therefore, the remaining provisions of the Civil Act on corporate corporations, excluding those that presuppose legal personality, are applied. Therefore, confirmation of members is a very essential element in church decision-making and operation, and is the basis for preventing church disputes and resolving them quickly and rationally. However, in reality, it is difficult to confirm members due to the autonomy of religious groups, non-interference of the state, insufficient church administration, and diversification of types of members. Therefore this papeer examines the reasons why confirmation of church members is necessary, the types of church members by denomination, and the procedures for acquiring their status, examine and prepare for legal issues such as withdrawal from the church, long-term absence, and disciplinary trials, and examine practical methods for preventing and resolving disputes surrounding confirmation of church members.
