생성형 AI를 사용한 특허명세서 작성 및 이에 대한 특허심사 시 쟁점에 관한 고찰

국문 초록

이 글에서는 생성형 AI인 ChatGPT를 사용하여 특허명세서를 생성하였으며, 이에 대하여 실제 특허심사 시에 고려되는 사항에 대하여 살펴보았다. 특허명세서의 생성을 위해 이차전지 분야의 최신 논문을 AI의 학습에 사용하였다. 이후 프롬프트 엔지니어링으로 명령어를 입력하는 방식으로 특허명세서를 생성하였다. 생성된 특허명세서는 학습을 위해 인용한 논문과는 달리 다층 구조체가 형성되었으며, 이는 AI에서 나타나는 일종의 환각 현상으로 추측된다. 이후 생성된 특허명세서를 실제 특허출원으로 가정하고 특허심사 시 주요 논점을 검토하였다. 첫째, 특허출원서 심사 단계에서는 AI를 사용하여 특허발명을 생성한 자를 발명자로 인정할지 검토하게 된다. 그러나 특허출원서에 자연인이 발명자로 기재되어 있다면, 특허심사관은 발명자란에 기재된 발명자의 진정 여부보다는 실체심사 단계에서 특허명세서의 특허요건 및 기재요건을 위주로 판단할 것으로 사료된다. 둘째, 생성된 특허명세서의 기재요건과 관련하여, AI에 의해 생성된 실시예에 대한 실시가능성을 담보하기 위하여, 기술 분야에 따라 실시예에 대한 공인기관의 시험성적표 등을 특허출원 시에 첨부하는 방안을 고려할 필요가 있다. 셋째, 특허요건의 심사 단계에서 상용 AI를 사용하는 것은 특허발명 및 이에 대한 정보를 조기에 공개하는 효과가 있으므로 이에 대한 위험성이 있을 수 있다. 한편, AI에 의해 단시간에 양산 되는 발명을 고려하면, 확대된 선출원에서도 진보성 판단이 가능토록 하여 AI에 의해 양산되는 특허의 권리화를 저지할 필요가 있다. 한편, 거절이유 통지에 대한 대응방안으로 출원인은 심사관이 통지한 거절이유를 AI에 학습시킴으로써 심사관의 거절이유에 대한 검증을 수행할 수 있다. 그 외 특허업무를 대리하는 변리사도 AI를 활용할 수 있으나, AI의 자기 학습 기능을 고려한다면 상용 AI는 선행발명 조사 정도로 제한하여 사용하는 것이 바람직하다.

영문 초록

In this article, a patent specification was generated using a generative AI, ChatGPT, and the matters to be considered during actual patent examination in relation to this were examined. Subsequently, assuming the generated patent specification to be an actual patent application, the main issues in patent examination were reviewed. First, during the examination stage of a patent application, it is examined whether a person who has used AI to generate the invention can be recognized as the inventor. However, if a natural person is indicated as the inventor in the patent application, it is considered that the patent examiner is more likely to focus on the requirements for patentability and the requirements of the patent specification during the substantive examination, rather than verifying the authenticity of the inventor as stated in the inventor field. Second, with regard to the written description requirement of the generated patent specification, in order to ensure the actual implementability of the embodiments generated by AI, it is necessary to consider requiring, depending on the technical field, the submission of test reports or the like issued by authorized institutions at the time of patent filing. Third, the use of commercial AI in the examination stage of patentability requirements may pose certain risks, as it has the effect of disclosing the patented invention and related information at an early stage. Meanwhile, considering inventions that are mass-generated by AI within a short period of time, it is necessary to prevent the grant of rights for such AI-generated patents by enabling the assessment of inventive step even under the framework of extended first-to-file rule. Meanwhile, as a measure to the notification of reasons for refusal, the applicant can perform verification of the examiner's reasons for refusal by training the AI with them notified by the examiner. In addition, patent attorneys who represent patent-related work can also utilize AI; however, considering the self-learning function of AI, it is preferable to limit the use of commercial AI to the extent of prior art search.
