국문 초록

2024. 12. 3. 대통령은 대한민국 전역에 비상계엄을 선포하였고, 비상계엄에 반대하는 시민들의 자발적 저항, 국회 등에 투입된 군인과 경찰의 소극적 임무수행, 국회의 신속한 계엄해제요구를 통해 6시간만에 비상계엄이 해제되었다. 이어 국회는 대통령의 비상계엄선포행위가 헌법에 위반됨을 사유로 탄핵소추안을 의결했고, 헌법재판소는 국민의 신임을 중대하게 배반한 대통령을 파면하는 결정을 선고하였다. 헌법재판소의 파면결정은 우리 헌정사의 오욕이었던 비상계엄선포와 관련하여 냉정한 법적 평가와 함께엄중한 책임을 물었다는 점에서 매우 큰 의미가 있다. 이번 사태를 계기로 긴급조치권의 오남용에 대한 원인을 분석하고 이를 예방하기 위한 제도적 개선방안을 심각하게 고민해야 한다. 정치적으로 무능하고 법적으로 무지한 대통령 한사람의 탓으로 돌리기에는 그 후유증이 너무 크고 깊기 때문이다. 국가긴급권의 본질과 요건, 내용 등에 대한 분석과 평가를 통해 국가긴급권이 본래의 역할과 기능에 충실하게 운용될 수 있도록 개선방안을 모색하여야 한다. 이번 사건으로 우리 정치현실에서 계엄제도의 필요성과 정당성에 관해 근본적인 의문의 제기하는 견해도 충분히 수긍할 수 있고, 또한 이에 공감하는 사람도 많다. 그러나 계엄제도를 비롯하여 국가긴급권은 헌법이 비상상황에 대비해 예외적 수단을 제공함으로써 국가권력이 헌법으로부터 더욱 멀어지지 않도록 묶어두는 안전장치이기 때문에, 위기극복을 위한 실효적 수단을 제공하면서도 법치국가적 한계를 명확하게 설정하는 것이 필요하다. 본 연구를 통해 우선 국가비상사태를 해소하기 위한 우리 헌법상 국가긴급권제도의 현황과 입법연혁, 주요국가의 입법례에 대한 비교법적 연구를 수행하고, 이를 전제로 현행 계엄법제에 관한 분석과 헌정사에서 계엄 등 국가긴급권의 발동사례를 평가하며, 이를 토대로 현행 계엄제도 등 국가긴급권의 개선방안을 제시하기로 한다.

영문 초록

On December 3, 2024, the President declared a state of emergency martial law across the Republic of Korea. However, within just six hours, the declaration was lifted due to spontaneous resistance by citizens opposing the measure, the passive response o f military a nd p olic e forc es d eployed to t he National Assembly and elsewhere, and the Assembly’s swift demand for its termination. Subsequently, the National Assembly passed an impeachment bill, c iting the President’s martial law declaration as a violation of the Constitution. The Constitutional Court then ruled to remove the President from office, determining that he had gravely betrayed the public trust. The Court’s decision to dismiss the President carries great significance, as it not only represents a stern attribution of responsibility but also a cool-headed legal assessment of the martial law declaration, which marks a disgraceful chapter in our constitutional history. This incident must prompt serious reflection on the causes behind the abuse of emergency powers and the need for institutional reforms to prevent such misuse in the future. The consequences of this crisis are too severe and deep-rooted to attribute solely to the incompetence and legal ignorance of a single political leader. A thorough analysis and evaluation of the nature, conditions, and scope of emergency powers is essential to ensure they are exercised in accordance with their original purpose and function. Understandably, many now question the legitimacy and necessity of the martial law system within our current political reality. This is a sentiment widely shared and accepted. However, emergency powers, including martial law, are constitutional safeguards designed to keep state authority tethered to the Constitution, even in extraordinary situations. Therefore, it is essential to ensure that while they provide effective means of overcoming crises, they must also remain clearly bounded by the principles of a rule-of-law state. It is time we stop turning a blind eye to the martial law system out of fear that invoking it might lead to abuse under the guise of crisis. Instead, we must critically reassess it—revise what needs fixing, discard what no longer serves its purpose, and relegate it back to its rightful place in the c onstitutional framework. It must only be used sparingly and wisely when truly necessary.
