국문 초록

형사사건에 대한 실체적 진실발견과 형사사법정의 실현을 위한 국가 형사사법기관 간 공조 및 협력은 중요하고 사건의 규모, 분량에 상관없이 개별 범죄사건의 해결 및 입증여부 역시 피해자 등 사건당사자에게는 매우 중요하다. 따라서 효율적이고, 신속한 그리고 과학적 수사를 위하여 경찰청이운용하고 있는 AFIS 체계에 대한 각급 형사사법기관 간 상호운용 가능성을 긍정적으로 검토하는 것이 필요하며 법과학 및 과학수사를 위한 지문학의 역할, 국내의 지문자료 관리의 법령상 근거, 각급 감정부서(공공기관 및 민간연구소)의 연혁 및 최근 운용동향, AFIS 운용체계, 잠재지문 현출 및감정체계 실태, 타기관간 지문자료검색 등 상호운용 상황, 국내 상황 개선을 위한 바람직한 방안이 필요하다. 이 연구는 미국의 지문자료 관리 시스템 및 공유동향에 관한 연구를 통하여 이를 대한민국의 공유동향과 비교 분석하고 이를 통한 범죄수사의 신속/효율성을 높이고, 수사기관의 과학적 수사역량을 제고하고, 사건관계자에 대한 인권침해 가능성을 줄이는 데 기여하기 위한 목표를 두고 있다. 이러한 연구내용과 절차를 충족시키기 위하여, 문헌자료를 최대한 입수하여, 분석/활용하였다. 또한 미국에서의 지문자료 관리시스템업무와 관련하여 공식적으로 소개하고 있는 인터넷 자료와 전문가들이 언급한 내용 및 AFIS 제품 공급회사가 소개한 내용 등을 참고하였다.

영문 초록

Cooperation and cooperation between state criminal justice agencies for the discovery of substantive truth about criminal cases and the realization of criminal justice are essential. Regardless of the size and quantity of the case, the resolution and verification of individual criminal cases is very important to the parties to the case, such as victims. Therefore, it is necessary to positively review the interoperability of the AFIS system operated by the National Police Agency for efficient, rapid, and scientific investigation, the role of fingerprinting for legal science and scientific investigation, the legal basis for fingerprint data management in Korea, the history and recent operational trends of various appraisal departments (public institutions and private research institutes), the AFIS operation system, the current status of potential fingerprints and the appraisal system, the interoperability situation between the National Police Agency, the Ministry of Justice, the Ministry of National Defense, the Prosecutor's Office, and other agencies, and the domestic situation is desirable measures are needed to improve the domestic situation. Through research on fingerprint data management systems and sharing trends in the United States, this study aims to increase the speed/efficiency of criminal investigations, enhance the scientific investigation capabilities of investigative agencies, and reduce the likelihood of human rights violations against those involved in the case. In order to satisfy these research contents and procedures, literature data were obtained, analyzed, and utilized as much as possible. It also referred to the Internet data officially introduced in relation to the work of the fingerprint data management system in the United States, the contents mentioned by experts, and the contents introduced by the AFIS product supplier.
