집회의 자유와 대화경찰관 제도에 관한 소고

국문 초록

헌법은 집회의 자유를 국민의 기본권으로 보장함으로써, 평화적 집회 그 자체는 공공의 안녕질서에 대한 위험이나 침해로서 평가되어서는 아니 되며, 개인이 집회의 자유를 집단적으로 행사함으로써 불가피하게 발생하는 일반대중에 대한 불편함이나 법익에 대한 위험은 보호법익과 조화를 이루는 범위 내에서 국가와 제3자에 의하여 수인(受忍)되어야 한다는 것을 헌법 스스로 규정하고 있는 것이다. ‘대화경찰관’은 집회나 시위 등 사회적 갈등의 현장에서 시위대(示威隊)와 인근주민 등과 적극적으로 소통하면서 갈등을 해소하는 역할을 맡은 경찰을 말한다. 한국형 대화경찰관(Dialogue Police) 제도는 집회·시위 현장에서 발생하는 각종 물리적 충돌과 갈등을 막기 위해 스웨덴의 집회시위 관리정책과 영국의 집회연락관을 벤치마킹하여 2018년 10월부터 시행하고 있다. 대화경찰은 집회·시위 현장 인근의 불만과 요구 사항을 집회주최 측에 전달해 중재하고, 집회·시위 참가들과 소통해 평화적 분위기 조성을 지원한다. 또한 집회가 물리적 충돌로 확산되지 않도록 노력하고, 집회 주최 측이 불만을 표출하면 협의를 진행하기도 한다. 집회·시위 시작 전 집행부와 사전 논의를 통해집회·시위와 가두행진, 가두행진 시작시간·경로·해산시간 조정, 다른 단체와의 마찰 방지 등 평화적 이고 비폭력적인 집회·시위가 될 수 있도록 다양한 역할을 수행한다. 우리 사회는 시민들의 권리의 식의 향상과 사회 변화를 요구하는 목소리가 다양하게 표출되고, 노동 분야의 정규직화 요구 등 각종 사회･이익단체에 의해 주최되는 집회·시위 등이 증가하고 있지만, 집회 시위의 증가에도 불구하고 불법·폭력 시위는 늘지 않은 것으로 나타났다. 이는 시민들의 법질서 준수 의식의 향상과 아울러집회현장 인근주민 등과 집회 주최측을 비롯한 참가자와 경찰 간 소통 창구 역할을 하는 대화경찰관 제도의 시행 등 집회현장에서 평화적 집회·시위 보장을 위한 경찰의 노력이 합쳐진 결과라고 할수 있다. 평화적 집회시위문화 조성에 기여하는 한국형 대화경찰관제도가 우리 사회에 안착될 수 있도록 대화경찰의 권한과 임무 등을 경찰청 훈령보다는「집회 및 시위에 관한 법률」에 대화경찰관조항을 신설하여 그 근거와 임무, 권한과 한계 등을 명확히 할 필요가 있다.

영문 초록

The Constitution guarantees the fundamental right of freedom of assembly to all citizens by stating, “All citizens shall have the right to freedom of speech and the press, and freedom of assembly and association.” The Constitution stipulates that peaceful assembly is not considered a danger or infringement on public order, and the state and third parties are required to accept any inconvenience to the general public or danger to legal interests arising from the collective exercise of freedom of assembly by individuals, provided that it is in harmony with the legal interests to be protected. To prevent various physical clashes and conflicts at rallies and protests, the Korean-style Dialogue Police system was implemented on August 1, 2018, benchmarking Sweden's Rally and Demonstration Management Policy and the UK's “Police Liaison Officer”. The Dialogue Police mediate complaints and demands from those near the rally or demonstration site to the rally organizers and communicate with rally and demonstration participants to create a peaceful atmosphere. They work to ensure that rallies do not escalate into physical clashes and may hold consultations with rally organizers if they express dissatisfaction. They play a variety of roles to ensure that rallies and demonstrations are peaceful and non-violent, such as coordinating the start time, route, and dismissal time of rallies, demonstrations, and roadblocks with the executive team prior to the start of the rally/demonstration, and preventing friction with other groups. Although there has been an increase in the number of rallies and demonstrations organized by various social organizations and interest groups demanding improvements to citizens' rights, social change, and regularization of the labor sector, the number of illegal and violent demonstrations has not increased. This is a result of the police's efforts to ensure “peaceful” rallies and protests, including the implementation of the Dialogue Police System. The system acts as a communication channel between the police and participants, including organizers and residents near the rally site, and improves citizens' awareness of law and order. The Korean-style dialogue police system contributes to the creation of a culture of peaceful rallies and protests. To ensure its establishment in Korean society, it is necessary to establish provisions on the dialogue police system in the Assembly and Demonstration Act rather than the National Police Agency Order. This will clarify the system's grounds, duties, powers, and limitations.
