「스토킹범죄의 처벌 등에 관한 법률」의 문제점에 대한 연구

국문 초록

지난 20여년간 무성한 논의에도 불구하고 입법되지 않았던 스토킹범죄에 대한 법률이 2021년 3월 24일 「스토킹범죄의 처벌 등에 관한 법률」이라는 법명으로 제정되어 2021년 10월 21일부터 시행 되고 있다. 이 법률이 시행되면서 스토킹범죄에 대한 처벌규정이 신설되어 중범죄의 관문이 되어 사회적인 논의를 확산하고 있는 스토킹행위를 선제적으로 차단하고 스토킹범죄의 피해자들을 보호할수 있는 근거를 마련했다는 점에서 타당한 입법이라 생각된다. 한편 스토킹범죄는 협박죄의 기수 전(前)단계에 해당하는 행위로서 이미 형법상 추상적 위험범으로 판단하고 있고, 미수범도 처벌하고 있는 협박죄의 미수범으로 처벌이 가능한 범죄행위이다. 또한 경찰관이 현장에서 시행하는 응급조치와 긴급응급조치 등은 본 법률이 제정되기 전에도 일반적으로 행하여지던 조치이다. 따라서 이미 형법상 처벌 가능성이 있는 행위로서 이미 일반 경찰행정작용으로 시행하고 있는 점을 감안할 때 이 규정을 신설하기 위해 특별법을 제정하는 것이 타당한지에 대해서는 비판적인 검증이 필요해 보인다. 결론적으로 이 법률의 각종 조치들에 대해서는 경찰행정작용의 일반법인 「경찰관 직무집행법」 에 규율하여 경찰관의 행정작용에 대한 일반적 권한을 두고 이 법률에서는 피해자보호를 위한 다양한 규정들을 중심으로 제정하는 것이 바람직할 것으로 보인다.

영문 초록

A law on stalking crimes, which had not been legislated for more than 20 years, was enacted on March 24, 2021 under the name of the 「Act on the Punishment of Stalking Crimes」 and came into effect on October 21, 2021. It is considered a valid legislation to newly establish provisions to punish stalking crimes and provide a basis for protection of victims affected by stalking crimes with the enforcement of this Act. Under the Criminal Act, attempted criminals are also punished as an abstract endangerment offense. Stalking is an act that falls under the pre-completion stage of a crime of intimidation and can be punished as an attempted crime of intimidation. Therefore, it is questionable whether it is necessary to enact a special law for crimes that may be punished under the Criminal Act. However, it is considered a valid legislation because the reason for punishing stalking crimes is to preemptively punish the act of gradually increasing damage and to protect the victim from crime through this. Nevertheless, as emergency measures were generally implemented by police officers on the spot even before this Act was enacted, it is still questionable whether it is reasonable to enact a special law to establish these provisions. Therefore, it would be desirable to regulate various measures in this Act under the general authority of police officers over administrative actions by the 「Act on the Performance of Duties by Police Officers」 and to prescribe for various provisions for the protection of victims under this Act.
