보건의료 빅데이터 활용 연구에서의 기관생명윤리위원회(IRB) 심의 쟁점 및 개선방안

국문 초록

이 논문은 보건의료 빅데이터와 관련한 국내 법률 및 가이드라인과 기관윤리위원회 심의현황에 대한 고찰을 바탕으로 기관위원회가 보건의료 빅데이터를 활용하는 연구를 심의하는 과정에서 발생하는 쟁점사항을 체계적으로 분석하여 쟁점사항을 해소하는 개선방안을 제시하는 것을 목적으로 하고 있다. 연구방법으로는 탐색적 조사방법 중 기존의 연구를 참조하는 문헌조사방법을 주된 방법으로 하였으며, 보건의료 빅데이터의 활용 및 기관위원회 심의와 관련된 학위논문, 단행본, 학술지 논문, 법률 및 정부 부처 가이드라인 등의 자료를 분석했다. 이와 같은 분석의 결과 보건의료 빅데이터 연구에서 가장 중요한 연구계획 중의 하나인 비식별 처리의 실효성 논란이 제기되는 것을 확인하였다. 또한, 연구대상자의 동의와 관련한 예외적인 사항을 규율하는 법률이 명확하게 정립되지 않아 심의의 근거가 되는 판단기준이 모호하다는 것을 확인했다. 끝으로 현재의 법률에는 보건의료정보 보호를 위한 개별법이 존재하지 않는다는 점이 연구대상자의 개인정보보호 측면의 논란을 유발시킨다는 점을 발견하였다. 이와 같은 발견을 토대로 쟁점을 최소화할 수 있는 방안으로 합리적인 비식별화 방안을 모색해야 하고, 생명윤리법에 제시된 동의 면제 관련 판단기준을 명확히 해야 하며, 보건의료정보 보호를 위한 개별법 마련이 필요하다는 점을 제시했다.

영문 초록

This study aims to examine issues arising when reviewing on research using healthcare big data and discuss ways to improve it to create a review environment that meets the intrinsic values of the Institutional Review Board. The issue of review was derived by analyzing domestic laws and guidelines related to healthcare big data. Accordingly, improvement plan were proposed on issues related to 'de-identification', 'waiver of informed consent' and 'Personal Information Protection'. The summary of the study is as follows. First, It was confirmed that the effectiveness of de-identification, a way to utilize healthcare big data for purposes other than the consent of the subjects, was raised. Since it is important to determine whether a person is identified in the process of review on research using healthcare big data, it is necessary to prepare criteria for the judgment of the Institutional Review Board based on the degree of de-identification. Second, It was found that the criteria for the review of the Institutional Review Board need to be established because the legislation governing matters related to waiver of informed consent is not clear. Third, The protection of healthcare information is regulated by the Personal Information Protection Act and individual laws, indicating that the Institutional Review Board is confused during the review process. Accordingly, the enactment of individual laws will be urged, and individual laws will have to cover the specificity of healthcare information, the authority and responsibility, and the effective guarantee of autonomy.
