경찰국 설치에 관한 쟁점 및 타당성에 관한 논의: 경찰통제 기능을 중심으로

국문 초록

2022년 8월 수많은 논란과 비판에도 불구하고 행정안전부 경찰국이 신설되었다. 경찰국 신설 당시에 많은 연구자들이 경찰 국 설치를 둘러싸고 다양한 논쟁을 펼쳐왔으나, 학자들의 합의는 전혀 이루어지지 않았으나 결국 경찰국 신설은 강행되었다. 그 러나 설치 3년차를 맞는 지금, 경찰국에 대한 학계의 관심은 많이 사라진 것으로 보인다. 이 연구는 당시의 쟁점을 간략히 정리 하고 경찰에 대한 민주적 통제장치로서 경찰국 설치가 과연 타당한 대안인지를 중점으로 살펴보았다. 치안사무에 관한 장관의 지휘·감독권 여부와, ｢행정안전부와 그 소속기관 직제｣ 제13조2의 위법성 문제, 경찰통제기구로서 경찰국의 타당성 문제 등의 쟁점에 관해 살펴본 결과, 경찰국 설치는 타당하지 않다는 결론에 이르렀다. 결국 기존에 경찰학자들이 주장해온 국가경찰위원 회의 실질화를 통해서만 경찰에 대한 민주적 통제가 가능할 것이다. 이 연구는 연구결과에 대한 실증이 부재하며, 자료입수의 한계로 지난 3년간 경찰국의 역할을 분석·제시하지 못했다는 점이 이 연구의 한계로 남는다. 다만, 이 연구를 통해 경찰에 대한 민주적 통제 기제로서 국가경찰위원회의 실질화 방안에 대한 구체적인 후속연구가 계속되길 기대한다.

영문 초록

Despite numerous controversies and criticisms, the Ministry of the Interior and Safety established the Police Bureau in August 2022. At the time of its establishment, many researchers engaged in debates surrounding the creation of the Police Bureau, but no academic consensus was reached. Nevertheless, the establishment was pushed forward. Now, in its third year, academic interest in the Police Bureau appears to have significantly declined. This study briefly summarizes the key issues at the time of its establishment and examines whether the Police Bureau is a viable alternative as a democratic control mechanism over the police. Specifically, it analyzes the Minister’s authority to direct and supervise police affairs, the legality of Article 13-2 of the Decree on the Organization of the Ministry of the Interior and Safety and Its Affiliated Agencies, and the validity of the Police Bureau as a police oversight body. The findings suggest that the establishment of the Police Bureau is not a valid solution. Instead, democratic control over the police can only be achieved through the substantive realization of the National Police Commission, as previously argued by police scholars. This study acknowledges its limitations, including the lack of empirical validation and the inability to analyze the role of the Police Bureau over the past three years due to data constraints. Nevertheless, it hopes to encourage further research on concrete measures to enhance the National Police Commission as a mechanism for democratic police oversight.
