15세기 부민고소금지법의 시행과 운영의 추이 - 凌上⾵潮 억제와 下情上達의 상관관계

국문 초록

본고는 15세기에 한정하여 부민고소금지법의 입법 및 시행 과정을 소원제도의 일환이라는 시각으로 살펴보았다. 부민고소금지법은 시행 전부터 백성들이 원억을 펼 수 없을 것이라는 문제를 안고 있었다. 이러한 문제를 해결하는 방법으로는 부민들에게 수령 고소를 허용하거나, 혹은 우선 수리한 이후자기원억에 해당할 경우만 청리하는 등의 방법이 있었고, 이와 반대로 수령의 행태를 감찰하는 방법이있었다. 전자는 부민고소금지법으로 제한된 백성의 고소를 풀어주는 방법이었고, 후자는 백성들이 받을 폐단을 애초부터 만들지 않게 하려는 방법이었다. 전자를 시행할 경우 고소가 늘어나 수령을 업신여기게 되는 능상의 사회 문화가 만들어졌고, 후자의 경우 부민고소금지법과 모순된다는 법률적 약점이있었다. 왕에게 이상적인 것은 하정상달이라는 명분에 근거한 백성들의 고소를 풀어주는 것이었다. 그러나이 방법은 수령을 업신여기게 되어 수령의 통치를 어렵게 했기에, 처음에는 이 방법을 택했어도 곧 철회하고 부민고소금지법과 함께 수령 감찰을 시행하게 되었다. 수령을 감찰하는 방법은 어사 인선, 파견 시기, 감찰 범위 등이 달랐지만, 찰방·감찰·분대 등을거쳐 侍臣을 보내는 것으로 변화했고, 파견은 비정기적으로 진행되었다. 감찰 범위는 백성의 질고를듣는 것과 수령의 업무를 감찰하는 것이었는데, 양자는 동전의 양면 같은 것으로 서로 떨어질 수 없는것이었다. 부민고소금지법은 능상풍조를 억제하기 위해 시행되었지만, 이는 곧 백성의 권리를 일부 제한하는것이었기에, 국가는 백성들의 제한된 권리를 보전하기 위해 다양한 방편을 모색·시도했다.

영문 초록

This study investigates the legislative and enforcement processes of the Law Banning People's Accusations Against One’s Superiors (部⺠告訴禁⽌法) in the 15th century, specifically interpreting it within the framework of the Petition System (訴冤制度). From the outset, the law raised concerns that it would deprive the people of a channel to express their grievances. In response, two primary solutions were proposed: one involved permitting people to accuse local magistrates, or accepting petitions initially and filtering them to address only legitimate injustices. The other solution was to strengthen Inspection (監察) of magistrates' conduct. The former approach focused on loosening restrictions imposed by the law, while the latter aimed at preventing grievances by regulating officials' behavior from the start. However, allowing people to directly petition against their superiors led to a rise in accusations and fostered Showing Contempt for One’s Superiors (凌上), undermining the authority of local officials. In contrast, the inspection-based approach revealed legal contradictions, as it conflicted with the principles of the Law Banning People's Accusations. While the ideal for the king was to ensure Making the Ruler Aware of the People’s Concerns (下情上達) by responding to petitions, this method encouraged the erosion of bureaucratic hierarchy and hindered effective governance. As a result, although it was initially adopted, the policy was soon replaced with a combination of the ban on accusations and institutionalized Inspection. The Inspection system evolved through several phases, with variation in the selection of inspectors, timing of deployment, and scope of authority. Over time, the process progressed from using regional agents such as chalbang, gamchal, and bundae to eventually dispatching royal attendants (sisin) on an ad hoc basis. The scope of their inspections included both listening to public grievances and assessing officials’ performance—two inseparable tasks that functioned as two sides of the same coin. Although the Law Banning People's Accusations Against One’s Superiors was enacted to suppress Showing Contempt for One’s Superiors (凌上), it inevitably limited the rights of the people. Consequently, the state explored various complementary mechanisms within the Petition System to preserve the people's restricted rights while maintaining hierarchical order.
