국문 초록

디지털혁명은 정보통신기술(ICT)의 발달을 바탕으로 사회전반에 걸쳐 급격한 변화를 가져오고 있으며, 이로 인해 전통적 사회안전망의 역할과 기능에도 변화가 요구되고 있다. 디지털사회안전망은 개인과 공동체가 경제적·사회적 충격으로부터 보호받을 수 있도록 돕는 시스템으로, 디지털기술을 활용하여 사회서비스의 접근성을 높이고, 효율성을 증대시키며, 포용성을 강화하는 것을 목표로 한다. 이 논문은 디지털사회안전망 구축을 위한 주요 법적 과제를 분석한 것이며, 개인정보보호, 디지털격차 해소, 디지털금융규제, 전자정부 운영, 정보통신관련 법률 정비 등을 포함한다. 개인정보보호는 디지털사회안전망의 신뢰성을 높이기 위한 핵심요소로, 데이터보안과 프라이버시침해 위험을 최소화하기 위한 법적 장치를 요한다. 또한, 디지털격차를 해소하기 위해 인터넷인프라 확충과 디지털리터러시 교육을 위한 법적 조치가 중요하다. 에스토니아의 전자정부와 디지털ID시스템, 핀란드의 기본소득실험, 한국의 디지털뉴딜과 개인정보보호 사례 등을 통해 각국의 법적 접근방식을 탐구하고, 이를 통해 국제협력과 법적 조화의 중요성을 살펴본다. 각국 사례는 디지털사회안전망구축의 법적 구현에 있어 다양한 시사점을 제공하며, 글로벌차원의 디지털사회안전망 발전을 위한 국제기준 마련과 협력체계 구축의 필요성을 강조한다. 디지털사회안전망의 성공적 구현은 법제도적 기반 마련과 지속적 고찰 및 개선을 통해 가능하다. 이는 모든 시민이 디지털시대의 혜택을 공평하게 누릴 수 있도록 하며, 사회적 포용성과 안정성을 강화하는데 기여할 것이다. 이러한 노력을 통해 우리는 포용적이고 지속가능한 사회를 구축할 수 있으며, 이는 디지털시대에 적합한 사회안전망의 발전을 위한 필수적 방향이 될 것이다. 이러한 발전은 미래사회의 안정성과 번영을 위한 기반을 마련하는 중요한 역할을 할 것이다.

영문 초록

The digital revolution is bringing about rapid changes across society based on the development of information and communication technology (ICT), and this is demanding changes in the role and function of traditional social safety nets. The digital social safety net is a system that helps individuals and communities protect themselves from economic and social shocks, and aims to improve accessibility, increase efficiency, and strengthen inclusiveness of social services by utilizing digital technology. This paper analyzes the major legal tasks for establishing a digital social safety net, including personal information protection, resolving the digital divide, digital financial regulation, e-government operation, and reorganizing laws related to information and communication. Personal information protection is a key element for enhancing the reliability of the digital social safety net, and legal measures are required to minimize data security and privacy infringement risks. In addition, legal measures for expanding the Internet infrastructure and digital literacy education are important to resolve the digital divide. We explore the legal approaches of each country through Estonia's e-government and digital ID system, Finland's basic income experiment, and Korea's digital new deal and personal information protection cases, and examine the importance of international cooperation and legal harmonization through these cases. The cases of each country provide various implications for the legal implementation of the digital social safety net, and emphasize the need to establish international standards and a cooperative system for the development of a digital social safety net at a global level. The successful implementation of a digital social safety net is possible through the establishment of a legal and institutional foundation and continuous review and improvement. This will ensure that all citizens can enjoy the benefits of the digital age fairly and contribute to strengthening social inclusion and stability. Through these efforts, we can build an inclusive and sustainable society, which will be an essential direction for the development of a social safety net suitable for the digital age. Such development will play an important role in laying the foundation for the stability and prosperity of the future society.
