종교문화유산의 보존 및 지원에 관한 입법론

국문 초록

종교문화는 문화의 범주 중 상당한 부분을 차지하고 있지만, 모든 종교문화를 포괄하는 일반법은 존재하지 않고 있으므로 전통사찰의 보존 및 지원에 관한 법률, 향교재산법 등을 기초로 종교문화유산 보호를 위한 입법론을 제시한다. 이에 대하여 고려할 사항으로는 국회 입법형성의 자유, 종교문화유산 보호에 대한 실증적 분석 등이 있고, 입법 전략으로는 현안 중심의 실제적 입법, 기존 종교문화유산 보호 법률과의 관계를 고려하는 방안 등이 있다. 법률안의 제명으로는 종교문화유산의 보존 및 지원에 관한 법률(이하 ‘종교문화유산법’)이 가장 무난할 것이고, 이 법의 체계상 지위 등에 대한 검토도 필요하다. 종교문화유산법의 구성으로는 크게 목적, 정의(제1조부터 제3조), 국가의 의무를 부여(제4조부터 제5조), 구체적인 등록, 허가 등의 사항(제6조부터 제16조), 기타 사항(제17조부터 제19조), 행정절차 등의 사항(제20조부터 제24조)으로 나눌 수 있다. 목적 등에서는 유형문화와 무형문화를 포괄하여 보존·지원을 할 수 있도록 하였고, 각 종교의 특색에 맞게 활용할 수 있는 포괄적인 조항으로 구성하였으며, 이미 기존 보호법률이 있는 경우에는 그 법률을 적용하도록 하여 기득이익을 보호하였다. 국가 등 의무편에서는 모든 국민에게 종교건조문 및 문화 등에 대한 침해·방해 금지의무를 규정하였고, 국가 등의 적극적인 책무를 부여하였다. 종교건조물의 지정 및 등록 절차에 관하여는 기존 법률 등을 보완하면서도 모든 종교를 포함할 수 있는 형태로 적절하게 규정하였고, 국가와의 행정절차도 보다 세부적으로 탄력적으로 발전시켰다. 종교건조문보존위원회의 구성에 관하여도 다양한 의견을 상정하여 하위법령까지도 국가의 책무를 세세하게 규정하는 반면, 종교건조물관리자의 선관주의의무도 빠뜨리지 않았다. 종교문화유산과 관련한 재산 처분 및 각종 개발행위에 관한 허가에 관하여는 기존 법률의 틀을 존중하면서도 특례조항의 필요성에 대하여 논의하였다. 기타 행정절차에 관하여는 행정기본법, 행정절차법 등을 반영하여 현행법과 조화를 이루도록 규정하였다. 끝으로 보조금에 관하여 그 범위를 확대하여 종교문화유산의 활용에까지도 국가의 지원이 미칠 수 있도록 하는 방안을 검토하였다.

영문 초록

There is supposed to be one unified substantive law of cultural heritage for every religion, considering the fact that religion in general is quite a substantial portion of inheritances for future generations. Consequently, it is in urgent need of legislation for comprehensive cultural heritage law for religion, and will be based on Korean Traditional Temples Preservation Act and Confucian School Property Act. Assessment about legislative discretion of Congress and practical analysis for measures to preserve cultural heritage of religion need to be preceded when it comes to enactment of law. Strategic approaches like pragmatic legislation with priority to current issues and cohesive lawmaking in harmony with heritage law in force are required for the next step. The title of this bill will be named as Act on the Preservation and Support of Religious Cultural Heritage. Plus what level the act will be placed in hierarchy of laws remains to be reviewed later. It includes the purpose of the legislation, the definition of terms(from Article 1 to 3), legal obligations to protect legacies(from Article 4 to 5), processes for registration and authorization in detail(from Article 6 to 16), the additional considerations(from Article 17 to 19), and necessary administrative procedures(from Article 20 to 24). The provisions over the purpose of this legislation state comprehensive support and preservation for cultural heritage in each religion whether it is tangible or not. Established legislation is still effective for the part not overlapped. The part of legal obligations states the prohitibition for any kind of vandalism and violence against religious heritage as it invests the nation with a good deal of responsibility. A process of registration as authorized religious structures is more consised along with administrative procedures. There will be the committee for religious heritage preservation for reflecting views from all levels of society. In addition, general managers of religious structures must exercise reasonable skills, care and diligence for its protection. Authorization for disposal and exploitation of religious heritage should not be abused, but exemption clauses will be prepared for special occasions. This act complies with General Act On Public Administration and Administrative Procedures Act about rest of administrative procedures. At last, it comes up with plans for government subsidies to maintain religious heritage.
