국문 초록

Research on the incidental consequences of crime based on theoretical logic is difficult to withstand empirical investigation conclusions. The theory of abolishing the accompanying consequences of crime is only an idealistic expression in academic theory, which does not conform to the current concept and cognition of the Chinese people, nor can it maximize the effectiveness of crime governance, and is not feasible. The normative theory of the consequences of crime can be affirmed by empirical investigations from a macro perspective, but there are many areas of debate regarding the specific normative content. From the perspective of legal sociology, studying the ancillary consequences of crime, combined with empirical investigation conclusions, can optimize the normative scheme of ancillary consequences of crime in terms of the formulation of subjects, application methods, implementation subjects, and relief measures.

영문 초록

基于学理逻辑展开的犯罪附随后果研究难以经受实证调查结论的检验。对犯罪附随后果提出的废除论只是学理上的理想主义表达，不符合当前我国民众的观念认知，也无法实现犯罪治理效果的最大化，不具有可行性。犯罪附随后果的规范论在宏观立场上可以得到实证调查的肯定，但在具体的规范内容上则存在颇多商榷之处。从法社会学视角研究犯罪附随后果，结合实证调查结论，可在犯罪附随后果制定主体、适用方式、实施主体和救济措施方面，优化犯罪附随后果的规范论方案。
