국문 초록

The legal responsibilities of online platforms mainly include civil legal responsibilities, administrative legal responsibilities, and criminal legal responsibilities. Different legal responsibilities should maintain effective connection and system coordination in the sense of overall legal order. In addition to legal responsibility, the social responsibility of the platform in the Internet era has some new characteristics compared with the traditional social responsibility. The social responsibility of the network platform has the characteristics of a platform community. In terms of social responsibility, it has more information resources advantages, and its social responsibility has different levels and types. Compared with traditional enterprises, online platforms have certain management power, which is also the legitimate basis for their active assumption of social responsibility. While emphasizing the social responsibility of online platforms, attention should also be paid to the stages of social responsibility of online platforms. Online platforms should actively practice social responsibility, with a focus on humanistic care, environmental protection, poverty alleviation, education, emergency social assistance, and other related areas. The social responsibility of online platforms should be categorized according to different content focuses. On the basis of typification of responsibility content, corresponding evaluation mechanisms should be established for the social responsibility of online platforms, and the social functions of online platforms should be actively utilized to ensure that they can actively undertake corresponding social responsibilities. We should follow the development trend of the platform economy and continuously define the content and boundaries of legal and social responsibilities of online platforms. While emphasizing the social responsibility of platforms, we should also pay attention to effective interaction with legal responsibilities.

영문 초록

网络平台的法律责任主要包括民事法律责任、行政法律责任与刑事法律责任，不同的法律责任之间应当在整体法秩序的意义上保持有效衔接与体系协同。除法律责任外，互联网时代的平台社会责任较之传统的社会责任存在一些新的特征，网络平台社会责任的承担具有一种平台共同体的特征，其在承担社会责任方面，具有更多的信息资源优势，其社会责任具有不同的层次性与类型化。与传统企业相比，网络平台拥有一定的管理权力，这也是其积极承担社会责任的正当性依据。在强调网络平台社会责任的同时，应当注重网络平台社会责任的阶段性。网络平台应当积极践行社会责任，网络平台的社会责任内容侧重于人文关怀、环保、扶贫、教育、紧急社会救助等。网络平台的社会责任应当按照不同的内容侧重予以类型化。在责任内容侧重的类型化基础上，应当针对网络平台的社会责任构建相应的评价机制，进而积极发挥网络平台的社会功能，以保障其能够积极承担相应的社会责任。应顺应平台经济的发展趋势，不断对网络平台法律责任与社会责任的内容与边界进行合理界定，在强调平台社会责任的同时，应当注重与法律责任的有效互动。
