국문 초록

적어도 최근의 공무원 선발시험 변화에서 법학을 홀대하고 있음을 느끼는 것은 이해당사자의 하나라서일지도 모르겠다. LEET, PSAT든 최근의 공개채용 시험의 경향은 전문지식보다는 인적 자질, 특히 이해력, 순발력을 중심으로 평가하려는 것으로 보인다. 이는 복잡하고 민감한 공채시험 관리를 쉽게 하고 싶은 담당기관의 이해와 시험준비에 드는 노력을 간소화하고 싶은 수험생의 이해가 맞물려 공직자로서 기본적으로 갖추어야 할 전문지식, 태도에 대한 평가를 가볍게 여기는 경향으로 진행되고 있다는 비판이 가능하다. 공무원에게 필요한 법적 지식, 태도를 가볍게 여기는 것에 대해서는 기본적으로 과거 정부가 몰이해를 지적하지 않을 수 없다. 9급 공무원 정도는 고교과정의 국영수 과목으로만 뽑아도 충분하다는 그 인식은 한국 대학교육에 치명적 결과를 초래했다. 공직자 가운데 특히 교정공무원, 경찰공무원과 그밖에 수사권한을 행사해야 하는 공무원은 일반 행정직 공무원과는 달리 볼 필요가 있다. 이들이 수사해야 하는 분야는 그 전제가 되는 법률 제도에 대한 최소한의 이해가 있어야 수사를 할 수 있는 것임은 당연하고, 특히 다른 공무원 직렬과 달리 그 직무수행 가운데 타인의 신체, 재산에대해 물리력 행사를 하여야 할 것이 예정된 공무원이기 때문이다. 이러한 권한이 부여된 대신 수사권한을 행사하는 자는 형법상 엄중한 책임을 묻는 구조이므로 그만큼더 법학적 소양이 필요한 직무이지만, 이 점은 너무도 간과되고 있다. 그래서 사전에 특별한 교육을 거쳐 일정한 법학적 소양을 가진 자를 선발하여야 함을 제안한다.

It is possible to criticize that Regarding the overall trend of simplification of the civil service recruitment exam, there are complaints that it is trying to make work too easy while the number of applicants is decreasing, and regarding the downplaying of the legal knowledge and attitude required for civil servants, it is impossible not to point out the basic lack of understanding of the past government. The perception that it was enough to select a 9th grade civil servant through the national exam subject in the high school curriculum had fatal consequences for Korean university education. Among public officials, especially corrections officials, police officials, and other public officials in many fields who must exercise investigative authority, if they fall into a certain rank or position, they become so-called ‘special judicial police officials’ through a separate procedure and exercise investigative authority. needs to be viewed differently from general administrative civil servants. It is natural that the field they must investigate requires a minimum understanding of the legal system as a prerequisite for investigation. In particular, unlike other civil servants, they must use physical force against the bodies and property of others while performing their duties. This is because he is a public servant with a scheduled job to do. Anyone who is granted this authority and instead exercises investigative authority is subject to strict liability under criminal law, so this is a job that requires even more legal knowledge, but this point is being overlooked. Therefore, it is proposed that people with a certain level of legal knowledge should be selected through special training in advance.
