국문 초록

국내 스토킹 범죄는 1999년 ‘스토킹 처벌에 관한 특례법’이 발의되면서 스토킹을 범죄로 인식하기 시작했다. 스토킹 행위에대한 정의와 처벌 근거에 대한 직접적 규정이 없다는 지적으로 2013년에 ‘경범죄처벌법’의 개정으로 처벌에 대한 근거가 마련되었다. 이로인해 지난 2018년 5월 112신고 시스템에 ‘스토킹’ 코드가 신설됨에 따라 스토킹 범죄통계와 사건 관련자 정보관리가체계적으로 이루어지기 시작하였다. 스토킹 범죄 신고는 2018년 2,767건에서 가장 최근인 2022년 29,565건을 기록하여 지난 5년간 약 10배 이상이 증가한 것으로 나타났다. 따라서 증가하는 스토킹 범죄와 현행법상 피해자 보호에 대한 한계점으로 인해 스토킹 범죄 가해자에 대한 정책적 개입이 필요한 상황이다. 따라서 이 연구는 해외의 스토킹 가해자에 대한 교정 및 상담 프로그램에 대해서 알아보고 국내의 스토킹 가해자에 대한 교정 및 상담 프로그램에 대한 필요성에 대해서 정책적으로 제언하고자 한다. 연구 결과, 영국과 일본의 경우, 경찰이 스토킹 가해자에 대한 조기 개입이 가능했으며, 특히 여러 기관이 협력하여 가해자에대한 치료와 상담 프로그램을 운영하여 효과성을 검증하였다.

영문 초록

As for domestic stalking crimes, stalking began to be recognized as a crime when the 'Special Act on Stalking Punishment' was proposed in 1999. It was pointed out that there was no direct regulation on the definition of stalking behavior and the basis for punishment, and the revision of the 'Misdemeanor Punishment Act' in 2013 laid the groundwork for punishment. As a result, With the establishment of a 'stalking' code in the 112 reporting system in May 2018, stalking crime statistics and information management related to the case began to be systematically carried out. The number of stalking crime reports has increased more than 10 times in the past five years, from 2,767 in 2018 to 29,565 in 2022, the most recent report. Therefore, due to the increasing number of stalking crimes and the limitations of victim protection under the current law, policy intervention is necessary for the perpetrators of stalking crimes. Therefore, this study aims to find out about correction and counseling programs for overseas stalking perpetrators, and to make policy suggestions on the necessity of correction and counseling programs for domestic stalking perpetrators. As a result of the study, in the case of the UK and Japan, it was possible for the police to intervene early against stalking perpetrators, and in particular, several institutions cooperated to operate treatment and counseling programs for perpetrators to verify their effectiveness.
