남북교류 확대를 대비한 방북 한국인의 신변안전 보호방안 모색

국문 초록

최근 남북관계는 이전 10여년의 기간에 비해 매우 진일보한 양상을 보이고 있어 남북 간의 교류와 협력의 지속적 증대는 물론 방북하는 우리 국민의 수를 크게 증가시킬 것으로 보인다. 그러나 이와 같은 현실에서 매우 철저하고 신중하게 검토되어야 할 정부 차원의 또 하나의 사안이 우리 국민에 대한 신변안전 확보 방안을 수립하는 것이다. 따라서 연구에서는 남북관계의 진전에 따라 급증할 수 있는 방북 수요를 살펴보고 이 과정에서 발생할 수 있는 신변안전 위협요인을 분석하였다. 그리고 이와 같은 신변위협 상황을 억제하기 위해 그동안 남북한 간에 작성, 체결한 주요 합의서상의 문제점을 도출하고 이를 통해 장, 단기적으로 추진해볼 수 있는 우리 국민의 신변안전 확보방안에 대하여 살펴보 았다. 연구결과, 방북하는 우리 국민들의 신변안전을 확보하기 위해서는 먼저「개성공업지구와 금강산관광지구의 출입 및 체류에 관한 합의서」의 제10조 제2항과 제3항, 제11조 등 신변 안전에 대한 추상적이고 미흡한 조항의 개정을 구체화하는 노력이 시급한 것으로 보인다. 또한 합의서 제12조에 명시되고 있음에도 불구하고 그동안 구성, 운영되지 않고 있는 ‘출 입․체류 공동위원회’를 조속히 구성하여 북한 내 특구 지역에 남북 공동 안전인력을 배치하는 등 보다 실질적인 신변안전 활동을 수행할 수 있는 방안을 모색해야 할 것으로 보인다. 그리고 중장기적으로는 개성공업지구와 금강산관광특구 뿐만 아니라 우리 국민이 방북하는 모든 북한지역으로 확대 적용될 수 있는 별도 합의서의 작성과 체결이 필요하고, 남북관 계가 더욱 획기적으로 개선된다는 전제 하에서는 남북한의 형사사법 당국이 상호 공조체제를 운영하는 방안도 논의되어야 할 것으로 판단된다.

영문 초록

Recently, South-North relations show great steps forward comparing to previous 10 years, which raises a possibility that exchange and cooperation between South and North increase continuously and the number of our people visiting North Korea will be on the sharp rise. In this reality, however, another issue that should be considered very throughly and cautiously at government level is to establish measures for securing personal safety of our people. Therefore, this study looked into the demand for visiting Korea which will increase rapidly according to the advancement of South-North relations, and analyzed factors threatening personal safety which may occur in the course of the foregoing. This study also deduced problems of main agreements prepared and concluded between South and North Korea for suppressing situations of life-threatening and examined measures for securing personal safety of our people we can promote in the long and short term through the aforementioned. Study results show that efforts for materializing revision of abstract and insufficient provisions for personal safety such as Clause 2 and 3 of Article 10 and Article 11 of the Written Agreement on Entrance and Stay of the Gaeseong Industrial District and the Mout Geumgang Tourism District」 are considered urgent first. In addition, a measure for fulfilling activities for more practical personal safety such as joint arrangement of human resources for safety within the special district in North Korea by organizing a ‘Joint Committee for Entrance ․ Stay’ that has not been organized and operated so far despite it is stipulated in the Article 12 of the Written Agreement shall be devised as well. For the medium and long term, preparation and conclusion of an extra agreement which can be applicable to the whole area of North Korea where our people visit as well as the Gaeseong Industrial District and the Mount Geumgang are necessary, and it is also judged that a plan for the criminal and judicial authorities of South and North Korea to operate a mutual-assistance system shall also be discussed based on the assumption that South-North relations will be dramatically improved.
