국문 초록

사회의 전반적인 민주화에도 불구하고 학교 내에서 학생의 인권은 아직 제대로 보장되고 있지 않다. 학교 안에서는 학생을 미성숙의 존재로 보면서 과도한 규제가 존재한다. 이러한 규제는 학생들의 동의를 바탕으로 한 것도 아니어서 학생들 스스로가 설득되기 어려우며 교사들에게도 과도한 학생지도의 부담과 어려움을 수반하는 게 현실이다. 학생인권조례는 모든 인간이 누리는 기본적 권리를 학생들이 학교생활에서도 누릴수 있어야 한다는 기본적인 인식을 구체화한 규범으로서, 2010년에 경기도를 시작으로 광주광역시와 서울시가 곧 시행하며 전라북도와 전라남도가 그 제정을 준비중이다. 인권을 보장한다는 것은 타인도 자신과 같은 삶의 주체이며 서로 다른 존재라는 것과 모든 인간이 자율적이라는 것을 인정하고, 인간이 가진 자유와 권리는 필요한 최소한으로만 제한되어야 한다는 것이라고 요약할 수 있다. 이 글은 학생인권조례의 제정의 동기와 목적, 그리고 이에 대해 제기되는 법적 문제점, 특히 교사의 교육권과의 충돌, 체벌의 위헌성 등 학생인권조례의 제정과 시행에 관련되는 몇 가지 중요한 법적 쟁점에 관하여 다룬다.

영문 초록

Human rights for students are still not being protected in school. Seen as the immature, many regulations are imposed on the students. Since they were not enacted by approval of the students, there are many implications that are hard for them to accept, and teachers are also having trouble with maintaining them. The ordinance on the protection of human rights for the students, which is now in process of enactment by the local government for education, is criteria which shaped up the fundamental belief that human rights enjoyed by the citizens should also be applied for the students in elementary to high school students. Starting from Gyoung-gi-do Province in 2010, City of Seoul and Jeollabuk-do Province are preparing for the legislation. Protecting the human rights means that everyone should recognize that: people around us are the subjects of their own lives; not every person is the same, and setting a limit on people should be as less restrictive as possible. This article comprehensively deals with the purpose of this legislation, some legal problems entailed by the ordinance, especially conflicts between teachers and the students, and the unconstitutionality of corporal punishment at school.
