학생인권조례의 현황과 공법적 쟁점

국문 초록

경기도의 학생인권조례 제정을 시발점으로 현재까지 총 11개 시도에서 학생인권 보장을 위한 조례 제정을 추진했거나 추진 중에 있다. 학생의 인권보호를 위해 지방자치단체의 자주법인 조례를 제정함으로써 학생인권을 더욱 강하게 보장하고자 하는 것은 매우 바람직한 일이다. 그런데 학생인권조례 제정에 긍정적인 입장도 있고, 부정적인 입장도 있어 갈등이 초래되고 있다는 점에서 이 연구는 학생인권조례 제정으로 인해 제기되고 있는 다양한 측면의 쟁점들을 분석하고 좀 더 학생의 인권보장을 위한 실질적 방안이 무엇인지 검토해 보고자 하였다. 전국적으로 학생인권조례를 제정하고자 하고 내용적인 측면에서 시도별 큰 차이가 없다면, 헌법 제117조에 근거한 시도의회의 자치입법권의 한계를 일탈하는 측면이 있고, 시도의 자치법규로서의 성격을 더욱 강화하기 위해서는 학교 이외에 가정, 지역사회에서의 인권보장을 위한 내용을 포괄하는 인권조례가 제정되어야 한다. 또한 법적 그리고 사회적으로 합의되지 않은 학생인권문제(체벌, 두발과 복장문제 등)에 대해서는 좀 더심도 있는 논의와 학생참여를 통한 학교규칙으로 제정하는 방안도 고려되어야 한다.

영문 초록

A total of 11 Municipal and Provincial Office of Education attempt to enacted ordinances for protection of the students human rights after enacting Gyeonggi-do students human rights ordinance in 2010. Recently, this is national trend to protect student`s rights, that is very desirable. But a student of human rights ordinance has surely some positive aspects but, have negative ones, too. So, this study will analyze and review the current status and a legal issues to being raised on ordinance of student`s human rights. As the result, I doubt whether ordinance is needed, because human rights ordinance are enacted across the nation, and there is no significant difference in lists of students human rights. So, I think that the national law as a student of human rights is more protect them than ordinance. And if they want to enact the ordinance, they have the character of the local government regulations. It will include the right which is related to the family and community, in addition to school. Additionally, students human rights is possible to protect through school rules which do not agree with the legal and social issues of human rights(corporal punishment, hair and costume issues, etc.) and that is needed for more discussions with students and lead to agreements.
