교육감 선임방식에 관한 헌법원리

국문 초록

현행법체계상 교육감 선임방식의 결정은 입법재량에 속한다. 그 입법재량의 준칙에 해당하는 헌법원리로 독자적인 교육행정기관인 교육감의 지위와 기대역할과 관련하여 교육의 자주성·전문성·정치적 중립성, 지역 차원의 대의민주제와 관련하여 지방자치의 원리, 교육감을 선출할 경우의 입법지침과 관련하여 선거권 및 선거의 기본원칙을 들 수 있다. 교육감 선거제도를 구성함에 있어서 교육의 자주성·전문성·정치적 중립성과 선거의 기본원칙이 상충될 수 있음을 정확히 인식하는 것이 중요하다. 여기서 양자의 조화가 문제된다. 선거의 기본원칙과 교육의 자주성·전문성·정치적 중립성의 조화를 꾀함에 있어서 부득이 우선순위를 결정하여야 할 경우에는 교육의 자주성·전문성·정치적 중립성을 우선하여야 한다고 본다. 한편 지방교육자치의 집행기관이 교육의 자주성·전문성·정치적 중립성을 견지하면서 이중의 자치를 지닌 상태에서 자치사무를 효과적으로 수행하기 위해서는 합의제 형태를 취하는 것이 낫다고 본다.

영문 초록

In Korea, the way to select and(or) appoint a superintendent may be decided by the legislative discretion. There are some constitutional principles as guidelines for the discretion: independence, professionalism and political neutrality of education (hereafter, the basic principles of education ) as for the status and expectations of the role of a superintendent; the principle of local autonomy with regard to representative democracy of the local dimension; right to elect and the basic principles of the election (i.e.universal, equal, direct, secret and free ballot) relating to the legislating an electoral system of superintendent. It is very important to recognize exactly the relationship between the basic principles of education and constitutional principles of election while composing the electoral system of superintendent. Both of them, in some cases, are contradictory and incompatible. Therefore arises a problem of harmonization of two principles. When both are not compatible, the basic principles of education should have priority over the other one. This paper also suggests that the best form of the executive organization of local educational affairs should be a council system in which decision-making is by not one person. Because the council system can perform local educational affairs effectively while not violating the basic principles of education.
