국문 초록

북한은 최근 아동권리보장법 제정으로 아동권리 및 복지에 대한 개념이 법제화되고 있는 경향을 보이고 있다. 하지만 관련 연구는 거의 부재한 것이 현실이다. 특히 북한의 아동복지와 관련한 연구는 주로 탈북자를 통한 실태 파악에 집중하고 있기에 법제도를 통한 함의 파악은 향후 주목해야 할 부분이다. 또한 통일 이후를 상정했을 때에도 법제도를 중심으로 한 사회통합방안 마련은 중요성을 가진다. 이에 본 연구는 아동권리보장법 및 북한의 아동복지 관련 법제도를 분석한다. 이를 통해 기존에 진행되지 않았던 북한의 아동복지 관련 법제도 현황을 파악하여 향후 남북한 사회복지 통합의 기초 자료로 기능하고자 한다. 한편 본 연구는 기존의 법해석학적 관점에서 나아가 사회복지정책의 분석틀을 활용하여 각 법제도를 사회복지학적 관점을 반영하여 분석하여 연구방법에 있어 법학과 사회복지학의 융합 연구를 시도하고자 한다. 본 연구의 결과는 다음과 같다. 첫째, 북한은 어린이보육교양법을 시작으로 복지 관련 법제도를 구축하기 시작한 후 사회적 약자를 위한 단일 법령을 제정하는 움직임을 보이고 있다. 그 중 아동권리보장법은 대표적 사회적 약자인 아동을 대상으로 한 법률로 아동관련 복지 영역을 권리 중심으로 통합한 법률이라고 평가할 수 있다. 둘째, 동 법률은 복지 관련 법제도가 제대로 정비되지 않은 북한의 특성상 유사 내용을 담을 여지가 있는 복지 관련 법률간 중복의 양상을 보인다. 셋째, 권리가 복지를 포함하는 광의의 개념으로 상정할 때 북한은 법정책상 아동복지 영역에 대한 인식을 하기 시작한 것으로 보인다. 특히 그 중에서도 보건과 보육 분야에 집중하고 있는 것으로 파악할 수 있다. 본 연구는 현재까지 상대적으로 연구가 미흡한 북한 아동복지 영역의 법제도 현황을 법학과 사회복지학 양자의 관점을 바탕으로 분석하였다. 본 연구는 향후 통일 한국의 사회복지 통합을 위한 정책적 기초 자료로 기능할 것으로 예상된다.

영문 초록

With the recent enactment of North Korean Child Welfare Act, North Korea shows the tendency to legalize the notion of the rights and welfare of children. Nonetheless, the reality points out a lack of existing literature on the subject. Especially since most of the current researches on North Korea’s child welfare focus on understanding the present state through North Korean defectors, further attention is needed to realize the related laws. Analyzing the North Korean laws in relation to child welfare including the Child Welfare Act, this research focuses on comprehending the current state of North Korean laws, aiming to carry out a basic research on South and North Korea’s socio-welfare unification in preparation to the reunification. The research exhibits the following results. Establishing welfare laws starting with the Nursery Law, North Korea shows a movement to draft legislations for the socially marginalized group. Representing the laws for disadvantaged people, the Child Welfare Act is a legislation that combined all areas of child welfare with an emphasis on the rights. This brings a repetitive complexion among the related laws. Presupposing the right as a notion that includes the welfare, North Korea inclines to comprehend the overall areas of child welfare, and at the same time focuses on health and nursery care. Through the holistic analysis of the current North Korean Child Welfare laws, which has been hardly conducted until now, this research is expected to be used as the baseline reference for the unified Korea in the future.
