「강원특별자치도 설치에 관한 특별법」제정에 따른 강원특별자치도교육청의 법적 지위와 쟁점 분석

국문 초록

강원특별자치도는 2023년 6월 11일부터 특별자치도로 새롭게 출범하였다. 강원특별법 제정은 지방자치권 강화를 위해 개별 지역의 독특한 사회적, 경제적, 환경적 욕구를 충족할 수 있는 맞춤형 지역 발전 사업을 추진할 수 있는 법, 제도적 기반 조성 의의를 가진다. 강원특별법에 내재된 지방자치단체장의 법적, 행정적, 재정적 권한이 강화되면서 교육감과 의 연계와 협력이 중요하게 되었다. 강원특별자치도의 자치권 강화는 특별법이라는 법령의 제정 및 개정을 기반으로 나름의 자치권 강화를 통해 별도 지역발전 사업을 추진할 수 있게 되었다. 강원특별법에 따른 강원특별자치도교육청은 2022년 학교자치 및 미래교육, 지방 교육자치 강화, 교육재정 확보 및 교육지원체계 구축의 3개 분야 14개 교육특례사항을 제안하였다. 그렇지만 2025년 현재 강원특별법에 반영된 특례사항은 강원형 자율학교 운영특례, 유초중등교육에 관한 특례, 농어촌유학에 관한 특례 3가지뿐이었다. 제3차 강원특별법 개정 시 반영할 특례사항은 국제학교설립 및 외국교육기관 설립운영에 관한 특례, 교육자치조직권에 관한 특례, 소규모학교 급식 운영 특례 3가지이다. 그리고 나머지 특례사항들은 장기 과제로 미루거나 추진을 포기한 것으로 분석되었다. 강원 지역의 특성을 고려한 교육 특례사항들의 강원특별법에 반영되는 입법화는 단지 3가지에 불과할 뿐 나머지 사항들은 현실적인 제약 등으로 인해 반영되지 않았다.

영문 초록

Gangwon State was newly launched as a special autonomous province from June 11, 2023. The enactment of the Gangwon Special Act has the significance of creating a legal and institutional foundation to promote customized regional development projects that can meet the unique social, economic, and environmental needs of individual regions to strengthen local autonomy. As the legal, administrative, and financial powers of local government heads inherent in the Gangwon Special Act were strengthened, linkage and cooperation with the superintendent of education became important. The strengthening of Gangwon State's autonomy has made it possible to promote separate regional development projects through strengthening its own autonomy based on the enactment and amendment of a law called a special law. According to the Gangwon Special Act, the Gangwon Special Self-Governing Province Office of Education proposed 14 special educational matters in three areas in 2022: school autonomy and future education, strengthening local education autonomy, securing educational finances, and establishing an educational support system. However, as of 2025, there were only three special cases reflected in the Gangwon Special Act on the operation of Gangwon-type autonomous schools, special cases on elementary and secondary education, and special cases on studying in rural areas. There are three special cases to be reflected in the third revision of the Gangwon Special Act: special cases on the establishment and operation of international schools and foreign educational institutions, special cases on the right to organize educational autonomy, and special cases on the operation of small school meals. In addition, it was analyzed that the remaining special cases were postponed or abandoned due to long-term tasks. There are only three legislations that are reflected in the Gangwon Special Act on Special Cases for Education considering the characteristics of the Gangwon region, but the rest were not reflected due to realistic restrictions.
