시･청각장애인 OTT･VOD 접근성 보장을 위한 법제도 개선 방안 연구

국문 초록

연구 목적: 본 연구는 디지털 미디어 환경 변화에 따라 시각·청각장애인의 OTT·VOD 서비스 콘텐츠 접근권을 실질적으로 보장하기 위한 법·제도 개선 방안을 도출하고자 하였다. 연구 방법: 한국, 미국, 영국, 독일, 호주, 일본의 장애인 관련 법령과 방송·통신 규정을 권고조항과 의무조항으로 나누어 비교분석하고, 법학자·미디어학자·입법조사관 등 전문가 자문을 실시하였다. 연구 결과: 한국을 비롯한 대부분 국가는 방송사업자에게 장애인방송 제공 의무를 부과하고 있으나, OTT·VOD 등 온라인 플랫폼에 대한 규정은 미비하였다. 이에 본 연구는 비실시간 장애인방송의 법적 의무화, 디바이스 및 플랫폼 접근성 강화, 정부 재정지원 및 인센티브 제공, 품질 모니터링 체계 구축, 사업자 보고 의무화, 국민 관심 콘텐츠 제공 확대, 정책 협의체 구성, OTT 사업자의 기금 분담 등 8가지 법·제도 개선 방안을 제시하였으며 관련 고시 개정 및 협의체 논의 사안도 함께 도출하였다. 결론: 비실시간 장애인방송 확대는 정보접근 평등과 디지털 포용 실현의 핵심 조건이다. 본 연구는 법제도 정비를 통해 장애인과 비장애인이 동등하게 콘텐츠를 이용할 수 있는 기반을 마련하고자 하였으며, 실효성 확보를 위한 입법적 후속 논의가 필요함을 제언한다.

영문 초록

Purpose: This study aims to propose legal and institutional reform measures to effectively guarantee access to OTT and VOD service content for persons with visual and hearing disabilities, in response to the evolving digital media environment. Method: The study conducted a comparative analysis of disability-related laws and broadcasting/telecommunications regulations in South Korea, the United States, the United Kingdom, Germany, Australia, and Japan, classifying relevant provisions into either recommendations or obligations. Expert consultations were carried out with legal scholars, media scholars, and legislative researchers. Results: While most countries, including South Korea, impose obligations on traditional broadcasters to provide disability-accessible content, regulatory provisions for online platforms such as OTT and VOD remain insufficient. Based on these findings, the study proposes eight key areas for legal and institutional improvement: establishing a legal mandate for non-real-time disability broadcasting; enhancing accessibility of devices and platforms; providing government funding and incentives; developing a quality monitoring system; introducing mandatory reporting requirements for service providers; expanding coverage of content with high public interest; forming a multi-stakeholder policy consultation body; and requiring OTT providers to contribute to the broadcasting and communications development fund. In addition, revisions to relevant ordinances and key issues for deliberation within the consultation body were identified. Conclusion: Expanding non-real-time broadcasting for persons with disabilities is a critical step toward ensuring equal access to information and promoting digital inclusion. This study aims to lay the institutional groundwork for equitable content access for persons with and without disabilities and calls for continued legislative discussion to ensure the effectiveness of these measures.
