테러방지법 입법 추진의 성공 요인에 관한 연구 - 전략적 관리의 관점을 중심으로

국문 초록

본 연구는 Moore의 정치적 관리 전략을 바탕으로 테러방지법 입법 과정에서 입법 찬성 측의 전략을 분석하고, 반대 측의 전략의 상호작용을 비교하여 정책 및 법령의 성공적인 도입 요인을 파악하고자 하였다. Moore의 전략 중에서는 기업가적 옹호, 협상 및 정책개발관리의 측면에서 사례를 분석하였고, 성공적인 정책 및 법령 도입 요인에 대해 아래와 같은 분석결과를 제시하였다. 첫째, 입법찬성 측인 정부와 새누리당은 입법 추진 과정 중 발생했던 여러 외부 사건을 이슈 프레이밍에 활용하여 갈등 범위와 행위자 유입을 관리하였고, 이를 통해 테러방지법 법제화에 힘을 실을 수 있었다. 둘째, 선거법 개정이라는 중요한 사안 또한 처리되어야 했기 때문에 테러방지법 처리의 기한이 있었다는 점이 입법 찬성 측에게는 추진 적기라고 판단되었다. 셋째, 시간적 제약과 함께 내용 수정을통한 반대측 대안 무력화 전략은 협상 측면에서 우위를 갖게 하였고, 강경한 협상 자세를 견지할 수있어 결국 테러방지법이 통과되었다. 결과적으로 테러방지법 입법 과정에서는 특히 적절한 시기에이슈 프레이밍 전략, 대안 무력화 전략이 주효했다고 볼 수 있어, 향후 찬성 측과 반대 측의 갈등이팽팽한 입법 또는 정책 도입 과정에서 위의 전략을 활용할 경우 정책 도입에 성공할 가능성이 높아질 수 있을 것이다.

영문 초록

Based on Moore's political management strategy, this study analyzes the strategy of the legislative proponents in the anti-terrorism legislation process. Also, with the comparison with that of opponents, the research identifies factors of a successful introduction of policies and laws. The study applies two factors, entrepreneurial advocacy, and negotiation and policy development management, which are components of Moore's framework. First, the government and the Saenuri Party, which are in favor of the legislation, managed the scope of the conflict and the influx of actors by using various external events that occurred during the legislative process to strengthen their issue-framing for anti-terrorism legislation. Second, since the revision of election law was another priority for the legislative body, this time-limit was used as a strategy by the proponents. Third, with the time constraints, the emasculation of BATNA(Best Alternative to a Negotiated Agreement) as one of negotiation strategy gave strength to the proponents, and they were able to maintain a better bargaining status, which eventually passed the Anti-Terrorism Act. As a result, the issue framing strategy at the appropriate time and the emasculation of BATNA strategy worked in the legislative process of the Anti-Terrorism Act, and those can be used in another legislative process of severe conflicts between the proponents and opponents.
