국문 초록

지능정보화사회에서 정보통신기술의 비약적인 발달과 함께 빅데이터 관련한 산업의 효율성과 신속성을 높이고 이윤을 극대화하기 위하여 개인정보의 임의적 활용이 더욱 필요하다는 목소리가 높아지고 있는 상황에서 정보주체의 권리를 보호하기 위한 노력이 그 어느 때보다도 시급한 시점이다. 개인정보에는 보건의료데이터 뿐만 아니라 개인의 사생활, 자율성, 그리고 신념과 관련된 중요한 정보가 포함된다. 개인정보에 대한 접근, 수정, 삭제 등 일련의 과정에서 개인정보보호는 개인의 존엄성과 인권과 직접적으로 관련되어 있다. 개인 본인의 정보에 관한 사항을 정보주체 스스로 결정하고 통제하는 권리인 개인정보자기결정권은 지능정보화사회에서의 기본권으로 법제화되어 존중될 필요가 있으며, 정보주체의 인지 없이 이루어지는 개인 정보의 집적 및 이용에 따른 폐해로부터 개인의 인격권을 보장하기 위하여 헌법상 기본권으로 인정되어야 한다. 본 논문을 통해서 개인정보자기결정권의 개념, 헌법적 필요성, 구성요소를 파악하고 보건의료 빅테이터 활용에 필요한 기본 윤리 의식 함양에 주는 의의를 살펴보고자 한다.

영문 초록

Personal information includes health care data as well as important information related to an individual's privacy, autonomy, and beliefs. In a series of processes of access, modification, and deletion of personal information, personal information protection is directly related to individual dignity and human rights. The right to self-determination of personal information, which is the right to decide and control matters related to one's information, needs to be legislated and protected as a basic human right in an intelligent information society, and is recognized as a constitutional right in many countries around the world to guarantee personal rights from the harmful effects of the accumulation and use of personal information without the recognition of the data subject. Through this paper, the concept, constitutional necessity, and components of the right to self-determination of personal information are identified, and the significance of the ethics necessary for the use of health care big data is examined.
