공동주택관리의 책무성 확보를 위한 역할책임에 대한 연구

국문 초록

본 연구는 공동주택관리에 있어 이해관계자들의 역할책임을 담보하기 위한 책무성 체계의 결함을 도출함으로써 공동주택관리 제도의 개선에 일조하고자 수행되었다. 자료 수집을 위해 관련 법령 등 문헌분석과 함께 전문가를 대상으로 반구조화된 심층인터뷰를 진행하였다. 분석 결과는 다음과 같다. 첫째, 관리주체의 업무와 주택관리사(보)의 업무와 관련하여 관리주체의 업무를 대리할 수 있는 주택관리사(보)의 책임에 대한 한계가 존재한다. 따라서 관리주체 업무의 대리 행위에 따른 책임을 명확하게 하는 제도적 정비가 이루어져야 한다. 둘째, 관리주체는 대부분 영세한 데다 신규 영업 및 재계약을 위한 활동에 집중하고 있어 정작 공동주택관리 업무는 자신들이 임명한 주택관리사(보)에게 미루고 책임을 지지 않는 행태를 보이고 있다. 따라서 관리주체 선정 시 해당 전문관리업체의 관리능력을 평가하여 입주자대표회의에 제공하는 제도적 장치가 필요해 보인다. 셋째, 입주자대표회의 구성원은 의결권 행사를 통해 공동주택관리에 관여하기 때문에 후보자의 범죄경력 조회 등을 철저히 하여 후보자의 자질을 검정하여야 하고 선출이 된 후에도 교육을 통해 충실의 의무를 다하도록 관리하여야 한다. 넷째, 공동주택관리 담당공무원의 경우도 전문직위 제도를 적용하여 장기간 복무하며 효율적으로 지도·감독업무를 수행할 수 있도록 함으로써 사후적 규제 중심에서 벗어나 이해관계자간 분쟁을 사전에 예방할 수 있도록 하여야 한다. 마지막으로 공동주택관리를 위한 대각적 책무성 관계에서 중심적 역할을 수행하는 외부회계감사의 선정방식을 현재 감사 대상이기도 한 입주자대표회의에서 선정하기보다 지방정부가 경쟁입찰 방식으로 선정하는 것을 고려할 필요가 있겠다.

영문 초록

This study was conducted to contribute to the improvement of the apartment management system by identifying deficiencies of the accountability system that secures the roles and responsibilities of stakeholders in apartment management. To collect data, we conducted semi-structured in-depth interviews with experts along with literature analysis of related laws and regulations. The results of the analysis are as follows. First, there are limitations to the responsibilities of the apartment management officer (AMO) who can act on behalf of the management company entitled to manage the apartment. Therefore, institutional arrangements should be made to clearly define the AMO’s responsibilities for the work on hehalf of the management company. Second, most of the management companies are small and focused on activities for new sales and renewal of contracts, so they show behaviors of not taking responsibility for the apartment management work by leaving it to the AMO they appointed. Therefore, it seems necessary to have an institutional device that evaluates the management capabilities of the relevant management companies when selecting the entitlted management company, and provides it to the tenant representative meeting(TRM). Third, since the members of the TRM are involved in the management of apartment complexes by exercising their voting rights, the candidates’ criminal records should be thoroughly checked to verify their qualifications, and even after they are elected, they should be managed through education to ensure that they fulfill their duty of integrity. Fourth, the professional position system should be applied to the public officials in charge of apartment management so that they can serve for a long time and perform guidance and supervision work efficiently, thereby moving away from post mortem activities and preventing conflicts between stakeholders in advance. Lastly, it is necessary to consider having the local government select external accounting auditors, who play a central role in the diagonal accountability relationship for apartment management, through a competitive bidding process.
