국문 초록

최근 수십 년간을 살펴보면 헌법개정이론은 헌법제정이론(foundational constitutional theory)과 상 당히 밀접하게 연관되어 있음을 알 수 있다. 동 이론에서는 한 국가의 국민은 효과적이기만 하다면 어떠 한 절차이든 활용하여 그 국가의 헌법을 개정, 수정 및 나아가 교체할 수 있는 권한을 행사할 수 있으며, 그러한 절차들이 개정, 수정 또는 교체될 기존 헌법에서 규정하는 절차들과 상충된다 할지라도(또한, 그 러한 개정의 본질이 일부 헌법조항들은 개정될 수 없도록 하는 기존헌법 내 문구와 상충된다 할지라도) 마찬가지라는 점에서 헌법개정에 대한 ‘법적’ 제한은 있을 수 없다고 본다. 헌법을 개정 내지 교체하는 국민의 권한에 대한 유일한 제한이 있다면 그것은 얼마나 신중하게 접근하느냐 하는 문제일 뿐, 법적 제 한의 문제는 아니다. 헌법개정의 사유로는 애초에 잘못 설계된 결정을 교정하는 것, 새로운 상황에 헌법을 맞추는 것, 또는 국가의 정체성의 변경을 나타내기 위한 것 등이 있다. 이러한 각각의 사유들에 관하여 보다 자세히 살펴 본다.

영문 초록

Recent decades have shown that amendment theory is tied quite tightly to foundational constitutional theory. That theory shows that there can be no legal limitations placed upon constitutional amendments, in the sense that a nation’s people can exercise its power to amend, alter, and even replace the nation’s constitution by using any processes that turn out to be effective, even if those processes are inconsistent with the processes laid out in the constitution that is being amended, altered, or replaced (and even if the substance of the amendments is inconsistent with language in the existing constitution purporting to insulate some provisions from amendment). The only limitations on the people’s power to amend or replace the constitution are prudential, not legal. Reasons for amendment include rectifying initially bad design decisions, adapting the constitution to novel circumstances, or to express changes in the nation’s identity. Each of these reasons receives closer examination.
