국문 초록

본 연구는 차량용 전장 부품의 미국 CBP 비특혜 원산지 판정에서 실질적 변형 기준 적용 방식을 분석하였다. 주요 사전심사 사례(AVM 카메라, 클락 스프링 어셈블리, 열 차단 시트)를 검토하여, 제조공정의 복잡성과 주요 구성 요소의 기능적 역할이 원산지 판정에 미치는 영향을 평가하였다. 분석결과, SMT 공정과 같은 고부가가치 공정이 원산지 판정의 핵심 기준으로 작용하며, 단순 조립 공정은 실질적 변형으로 인정되지 않음을 확인하였다. 이를 통해 대미 수출 시 비특혜 원산지 규정 준수와 경쟁력 강화를 위한 실무적·정책적 제언을 제시하였다.

영문 초록

Purpose: This study examined the U.S. Customs and Border Protection (CBP) nonpreferential origin determinations for automotive electronic components, focusing on the “substantial transformation” criterion in manufacturing. The key issues are identified, and recommendations for compliance are provided. Research design, data, and methodology: A qualitative case study approach was used to analyze the key CBP advance rulings. This study examined the practical application of substantial transformation criteria under 19 CFR § 134.1(b), integrating legal interpretations, manufacturing evaluations, and core component functions. Results: CBP determined that SMT processes in Korea quali fied as substantial transformation, granting a Korean origin, while simple assembly in China did not. High-valueadded processes and key components are critical in origin determination. Conclusions: This study underscores the importance of high-value manufacturing for Korean exporters to meet U.S. origin criteria. The recommendations included focusing on domestic high-value-added production (e.g., SMT processes), leveraging CBP advance rulings, and improving compliance with U.S. regulations to reduce trade risks.
