국문 초록

본 연구는 한국의 탄소배출권 거래제도를 통해 특정 산업 내 한국 기업에 무상으로 배출권을 할당한 것에 미국 정부가 상계관세 부과 대상으로 결정하게 된 배경과 이로 인해 한국 기업에 미칠 영향을 분석하고자 한다. 또한, 산업 및 기업 보호 차원에서 기업의 전략과 정부의 실무적 대응방안을 제시하는데 목적을 두고자 한다. 미국 정부는 한국의 특정 기업이 탄소배출권을 무상으로 할당받은 것이 보조금이기 때문에 상계관세 부과 대상으로 간주하였다. 이에 따라 한국 철강업계를 중심으로 무역 위험이 증가하고 있으며, 국제무역 규범과 환경정책 간의 충돌이 일어날 우려도 있다. 본 연구는 국제무역법원에서 내려진 최근의 판정사례를 중심으로 상계관세 부과의 법적 근거를 검토하고, 기업차원의 대응 전략을 제시하고자 한다. 또한, 한국 정부의 정책적 대응 방향을 제시하여 국제무역에서 지속 가능한 환경 정책과 조화를 이루는 방안을 모색해 보고자 한다. 본 연구를 통해 한국 기업들이 국제통상환경에서 경쟁력을 유지하는데 기여하고자 한다.

영문 초록

Purpose: This study examined the impact of the carbon emissions trading system on the imposition of countervailing duties on Korean companies and developed practical strategies. Research design, data, and methodology: This study evaluated dispute cases related to the countervailing duties imposed on Korean companies because of the free allocations of a carbon emission trading system. Results: The U.S. government considers Korea’s free allocation of carbon credits to specific industries a subsidy, increasing trade risks. The study identified the critical factors contributing to countervailing duty rulings and their impact on the Korean steel industry. Conclusions: This paper suggests that Korean companies must adopt proactive risk management strategies. In addition, policy recommendations are provided for the Korean government to align emission trading policies while minimizing trade disputes.
