원격의료 활성화를 위한 규제 개선방안 연구 - 현행 의료법 개정을 중심으로

국문 초록

원격의료는 현행 ｢의료법｣상 의사와 의료인 간의 원격자문만이 제한적으로 허용되기 때문에, 의사와 환자 간의 원격진료는 허용이 되지 않는다. 이러한 원격의료의 제한적 허용 규제로 인한 의료접근성의 제한으로 의료취약계층 등에 대한 원격의료가 제공되지 못하는 문제가 발생한다. 또한 코로나19 상황에서 안정적인 비대면진료가 수행되었고 선진 정보통신기술(ICT)을 확보하였음에도 불구하고, 원격의료산업 발전의 장애와 글로벌 원격의료시장의 선점 기회도 상실하게 되는 문제점도 초래된다. 이에 본 연구는 ‘국민 건강의 보호와 증진’을 중심으로 원격의료 범위 확대의 필요성을 명확히 인식하고, ‘환자의 의료접근성 향상’과 ‘환자의 안전성 확보’ 간의 합리적이고 타당한 균형점을 모색하고자 하였다. 정리하면, 원격의료와 관련 규제 현황을 살펴본 후에 원격의료의 제한적 허용에 따른 현행 ｢의료법｣의 문제점을 분석하였다. 그리고 의료서비스의 접근성 제고와 원격의료산업 발전 및 글로벌 원격의료 시장 선점이라는 ｢의료법｣ 개정의 필요성을 도출하였다. 이에 현행 원격의료 규제 개선방안으로써 ｢의료법｣상 원격의료 허용 범위의 단계적 확대, 환자의 안전성 강화, 의료계 등과의 소통과 협력 체계 구축 등을 다각적으로 제안하였다. 이를 위해서는 보다 안전하고 정밀한 원격의료산업의 지속적인 발전과 ｢의료법｣ 개정에 따른 사례들에 대한 면밀한 평가와 사후 평가도 이루어져야 할 것이다. 또한 보건복지부, 식품의약품안전처, 산업통상자원부 등 범정부 차원의 협력적인 지원체계도 요구된다. 향후 본 연구의 결과를 기초로 원격의료에 대한 후속적인 학문연구 증가와 합리적인 ｢의료법｣ 개정을 기대해본다.

영문 초록

According to the current Medical Service Act, telemedicine between doctors and patients is not allowed because only remote advice between doctors and medical personnel is allowed. Due to these restrictions on medical access, there is a problem that telemedicine for the medical vulnerable group cannot be provided. In addition, despite the fact that stable non-face-to-face treatment was performed in the COVID-19 situation and advanced information and communication technology(ICT), there is a problem in the development of the telemedicine industry and the opportunity to preempt the global telemedicine market is also lost. Therefore, this study clearly recognized the necessity of expanding the scope of telemedicine, focusing on ‘protecting and improving public health’, and sought a reasonable and reasonable balance between ‘improving patient access to medical care’ and ‘securing patient safety’. In summary, after examining the current status of telemedicine and related regulations, the problems of the current Medical Service Act due to the limited permission of telemedicine were analyzed. In addition, the necessity of revising the Medical Service Act was derived to improve the accessibility of medical services, develop the telemedicine industry, and preoccupy the global telemedicine market. Accordingly, as a way to improve the current telemedicine regulations, it was proposed in various ways to gradually expand the scope of telemedicine permission under the Medical Service Act, strengthen patient safety, and establish a communication and cooperation system with medical community, etc. To this end, the telemedicine industry should continue to develop more safely and precisely, and a close evaluation and follow-up evaluation of cases following the revision of the Medical Service Act should be conducted. A cooperative support system at the government level is also required. Based on the results of this study in the future, it is expected that follow-up academic research on telemedicine will increase and reasonable revision of the Medical Service Act.
