국문 초록

본 논문은 우리나라에서 점차 심각해지고 있는 빈집 문제의 현황과 원인을 다각적으로 분석하고, 이에 대한 법적·제도적 개선방안을 제시하는 데 목적이 있다. 최근 급격한 인구 감소와 고령화, 도시 공동화 현상 등 사회 구조적 변화로 인해 전국적으로 빈집의 수가 빠르게 증가하고 있으며, 특히 농어촌 지역과 지방 대도시에서 그 문제가 두드러지게 나타나고 있다. 빈집의 방치는 단순히 미관상의 문제를 넘어 붕괴 위험, 화재 및 범죄 발생, 우범지대화, 인근 부동산 가치 하락, 지역 공동체의 해체 등 다양한 사회적 문제를 야기한다. 현행 빈집 및 소규모주택 정비에 관한 특례법은 빈집 문제 해결을 위한 기본적 틀을 제공하고 있으나, 빈집의 정의와 범위의 불명확성, 빈집 정비 계획의 실효성 부족, 이행강제금 등 제도의 한계로 인해 실질적인 문제 해결에는 미흡한 실정이다. 이에 본 논문은 빈집의 발생 원인과 현황을 체계적으로 고찰하고, 현행 법제도의 문제점을 분석하여, 소유권과 공공의 이익 사이의 균형을 도모할 수 있는 법적 기반 마련의 필요성을 강조한다. 또한 지방자치단체의 빈집 관리 역량 강화와 중앙정부의 지원 확대, 빈집을 도시재생의 자원으로 활용하는 정책적 접근의 중요성을 제시한다. 아울러 외국의 성공적인 빈집 관리 사례를 비교·분석하여 국내 실정에 맞는 제도 도입 가능성을 모색한다. 이를 통해 빈집 문제에 대한 체계적이고 효과적인 대응 방안을 마련하고, 궁극적으로 도시 환경 개선, 주거 안전 확보, 지역 활성화 등 긍정적인 사회적 효과를 도출하고자 한다.

영문 초록

This paper aims to analyze the current status and causes of the increasingly serious vacant house problem in Korea from multiple perspectives and to propose legal and institutional improvement measures. Due to rapid population decline, aging, and urban hollowing-out-major structural changes in society-the number of vacant houses is rapidly increasing nationwide, with the issue particularly pronounced in rural areas and major provincial cities. The neglect of vacant houses leads to various social problems beyond mere aesthetic concerns, including risks of collapse, fire, crime, the formation of slums, a decline in nearby property values, and the disintegration of local communities. The current “Special Act on the Maintenance of Vacant Houses and Small-Scale Housing” provides a basic framework for addressing vacant house issues, but its effectiveness is limited due to ambiguities in the definition and scope of vacant houses, lack of effectiveness in maintenance planning, and problems with enforcement fines. Accordingly, this paper systematically examines the causes and current status of vacant houses, analyzes the limitations of the current legal system, and emphasizes the need to establish a legal basis that balances individual property rights with the public interest. The paper also highlights the importance of strengthening the vacant house management capacity of local governments, expanding central government support, and adopting policy approaches that utilize vacant houses as resources for urban regeneration. In addition, by comparing and analyzing successful foreign cases of vacant house management, the paper explores the possibility of introducing suitable systems for Korea. Through these discussions, the paper seeks to provide systematic and effective response measures to the vacant house problem and ultimately argues that such efforts can contribute to improving the urban environment, securing residential safety, and revitalizing local communities.
