국문 초록

본고는 허버트 앨런 자일스(Herbert Allen Giles)의 번역서 《Strange Stories from a Chinese Studio(聊齋志異)》 속 공안 소설을 통해, 판결에 따른 자일스의 문학적 해석을 분석하려고 한다. 《Strange Stories from a Chinese Studio》는 浦松嶺의 《요재지이》를 번역한 책으로, 1880년 영국 런던에서 처음 출판되었으며, 1908년 개정 이후 여러 차례 재출판되었다. 자일스는 포송령의 《요재지이》에 수록된 490여 편의 이야기 중 164편을 선택 번역하면서 다양한 장르의 이야기를 포함시켰는데, 그 중 공안 소설은 상당한 비중을 차지한다. 본고는 당시 영국 사회의 문학적 흐름과 사회적 변화를 통해, 자일스가 《요재지이》 속 공안 소설에 주목한 계기와 그 의미를 고찰했다. 또한, 판결에 따른 자일스의 문학적 해석을 분석하기 위해, 자일스가 번역한 공안 소설을 이승 판관의 판결과 저승 판관의 판결로 구분하여 각각 살펴보았다. 이승에서의 판결 이야기는 중국 사회에 뿌리 깊이 내린 유교 사상이 판결에 미친 영향을 반영해 서양 독자들이 중국의 판결 및 형벌을 이해하게 했다. 저승에서의 판결 이야기는 서양 독자들에게 서양인의 종교적 이념과 다른 중국인들이 지닌 독특한 종교적 사후관을 전달했다고 볼 수 있다. 따라서 자일스의 공안 소설 번역은 단순한 소설 번역을 넘어, 문화 간 이해와 법제적 차이를 조명하는 중요한 역할을 했음을 알 수 있다.

영문 초록

This paper aims to analyze Herbert Allen Giles’s literary interpretation of judicial decisions as reflected in the Gong’an fiction in his translation, Strange Stories from a Chinese Studio. Strange Stories from a Chinese Studio is a translation of Pu Songling’s Liaozhaizhiyi, first published in London in 1880 and subsequently reissued several times following a revision in 1908. In selecting and translating 164 of the roughly 490 stories contained in Liaozhaizhiyi, Giles incorporated a variety of genres, among which Gong’an fiction occupies a significant portion. This paper examines, in light of the literary trends and social changes in British society at the time, the motivation behind Giles’s focus on the Gong’an fiction in Liaozhaizhiyi and its significance. Furthermore, in order to analyze Giles’s literary interpretation of judicial decisions, the Gong’an fiction he translated is divided into two categories, those rendered by earthly judges and those rendered by judges in the afterlife. The narratives of judicial decisions in the realm of the living reflect the influence of deeply rooted Confucian ideology on judicial decisions in Chinese society, enabling Western readers to understand Chinese judicial decisions and punishments. In contrast, the narratives of judicial decisions in the afterlife convey to Western readers the unique Chinese perspective on the afterlife, which differs from the religious ideology of Westerners. Therefore, Giles’s translation of the Gong’an fiction played an important role not only as a literary translation but also in shedding light on cross-cultural understanding and legal differences.
