노인복지시설 내 학대 사건과 관련한 행정처분에 대한 취소소송 판례연구

국문 초록

본 연구는 「노인장기요양보험법」 제37조 제1항 제6호를 중심으로 2020년부터 2024년 상반기까지 시설이 종사자의 노인학대 행위로 인해 행정처분 조치가 이루어진 판례 중 일부승소 판결을 제외한 전부승소판결을 선정하여 판결문의 내용을 질적 분석하였다. 본 연구는 연구 질문을 통해 각 분석된 시사점을 토대로향후 정책적 제언을 도출함을 그 목적으로 하였다. 분석 판례는 모두 18건으로 연구 질문에 따라 크게 업무정지 6개월 미만인 경우와 지정취소처분 및 업무정지 6개월 이상인 경우로 나누어 분석하였다. 본 연구의결과는 다음과 같다. 첫째, 행정처분 기준의 모호성으로 인하여 소송이 유발됨을 확인할 수 있었다. 둘째, 행정기관의 증거 불충분과 법적인 근거의 미흡은 법률의 재정비라는 정책적 개선이 필요함을 확인하게 하였다. 셋째, 종사자의 인권 교육과 학대 예방 교육을 위한 예산지원의 필요성을 확인하였다. 넷째, 중증 질환자, 치매 노인을 위한 개별화 지원체계 정책이 마련되어야 함을 확인하였다. 마지막으로 시설 종사자의 ‘원아웃제도’의 법률적 문제를 확인하였다. 본 연구는 이러한 연구 결과를 중심으로 정책적 논의사항을 도출하면서향후 후속 연구의 방향성을 제시하였다.

영문 초록

This study analyzed judicial precedents concerning administrative disposition resulting from elder abuse incidents by staff members in elderly welfare facilities, focusing on the Long-Term Care Insurance Act from 2020 to 2024. It specifically selected cases with administrative disposition, excluding partial victories. Contents of court decisions were qualitatively analyzed. This research aimed to derive policy recommendations based on insights from analyzed cases, addressing key issues raised in judgments. Eighteen cases were analyzed. According to the research question, the analysis was largely divided into cases with less than six months of suspension of work and cases with cancellation of designation and suspension of work for more than six months. Results of this study are as follows. First, ambiguity in administrative sanction criteria led to litigation. Second, insufficiency of evidence and lack of legal foundations in administrative actions indicated a need for legal reform. Third, this study emphasized the need for budget allocation to support human rights education and abuse prevention training for staff. Fourth, the need for individualized care systems for patients with severe illnesses or dementia was highlighted. Lastly, legal issues surrounding the ‘one-out’ system for facility staff were identified. Based on these findings, this study proposed policy discussions and outlined directions for future research.
